Summary Minutes:Regular City Commission Meeting May 16.2013 City of Sunny Isles Beach.Florida <br /> 10C. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida,Approving <br /> Change Order No. I to Agreement with USA Shade & Fabric Structures, Inc. for the <br /> Installation of a Playground Canopy at Heritage Park, in an Amount Not to Exceed <br /> S7,535.00, Attached Hereto as Exhibit "A". Bringing the Total Contract Amount Not to <br /> Exceed to $342,158.00; Authorizing the City Manager to Do All Things Necessary to <br /> Effectuate this Resolution; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Cultural and Community Services Director <br /> Susan Simpson reported that this was for a project already completed. There are a couple of <br /> things to close out that they are still going to complete but this is specifically for Heritage <br /> Park pan of the project. When they were digging up for the foundation they ran into some <br /> unexpected debris under the base that took extra time to excavate. <br /> Public Speakers: None <br /> Mayor Edelcup said you specifically mentioned that the extra cost was incurred because of <br /> some debris underneath, and so his question is to the City Attorney. is this cost chargeable <br /> back to the Contractor who originally built Heritage Park? If the Contractor had done a <br /> proper job perhaps this debris would not have been there and we wouldn't have had to spend <br /> this additional money. City Attorney Ottinot said he would review the contract and also <br /> investigate the matter with Ms. Simpson, and eventually if they are at fault we can definitely <br /> send a demand letter and request repayment. Commissioner Scholl asked if the City has <br /> settled with them yet, and City Attorney Ottinot said we have settled the construction <br /> contract with them and they have received all payments. He also noted that Coastal is doing <br /> business in the City. Mayor Edelcup stated that if there was a hidden defect we ought to <br /> pursue whatever legal remedies that we can. <br /> Vice Mayor Aelion moved and Commissioner Gatto seconded a motion to approve the <br /> Resolution. Resolution No. 2013-2056 was adopted by a voice vote of 5-0 in favor. <br /> 10D. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving <br /> an Agreement with Firepower Displays Unlimited, Inc. to Provide a Fireworks Display <br /> at the Dedication Ceremony of the Sunny Isles Beach/Newport Fishing Pier on <br /> Saturday, June 15, 2013. in an Amount Not to Exceed 512,000.00, Attached Hereto as <br /> Exhibit "A"; Authorizing the Mayor to Execute Said Agreement; Authorizing the City <br /> Manager to Do All Things Necessary to Effectuate this Resolution; Providing for an <br /> Effective Date. <br /> Action: City Clerk Hines read the title, and Cultural and Community Services Director <br /> Susan Simpson reported that the event is on Saturday, June I 5. 2013 from 7:00 to 9:00 p.m. <br /> At approximately 9:00 p.m., they will have some fireworks, it will be a 10-minute show. She <br /> noted that the City's 16th Anniversary Party will be held on the following day at Town Center <br /> Park from noon to 4:00 p.m., and she encouraged everyone to get their Resident ID card. <br /> Public Speakers: None <br /> Commissioner Scholl moved and Vice Mayor Aelion seconded a motion to approve the <br /> Resolution.
