ORDINANCE NO. 2013 - 4 t J <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 <br /> "ZONING" SECTION 265-34 OF THE CITY CODE TO CLARIFY <br /> PERMITTED RETAIL AND OFFICE USES WITHIN THE MEDIUM- <br /> HIGH DENSITY MULTIFAMILY RESIDENTIAL (RMF-2) DISTRICT; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF <br /> CONFLICTING PROVISIONS; PROVIDING FOR INCLUSION IN THE <br /> CODE; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of this Ordinance is to promote the public health, safety and <br /> welfare of the residents of the City of Sunny Isles Beach in the use and development standards <br /> for multi-family and hotel uses within the City which from time to time need to be clarified and <br /> adjusted; and <br /> WHEREAS, from the inception of the City, limited retail and office uses have been <br /> permitted within the Medium-High Density Multifamily Residential (RMF-2) district and such <br /> uses are customary and appropriate uses when properly restricted; and <br /> WHEREAS, on , 2013, the City Local Planning Agency, pursuant to <br /> Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed <br /> amendments to the City land development regulations. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby <br /> ratified and confirmed as being true and correct and are hereby made a specific part by this <br /> Ordinance upon adoption hereof. <br /> Section 2. Amendment. Chapter 265, "Zoning", Article VII "Zoning Districts", Section <br /> 265-34 of the City Code is amended to read as follows: <br /> § 265-34. - Medium - High Density Multifamily Residential (RMF-2). <br /> A. Purpose. The Medium - High Density Multifamily Residential (RMF-2) District provides <br /> for single-family, duplex, townhouse, medium-density and high-density residential development <br /> of multifamily dwellings at a maximum density of 60 dwelling units per net acre consistent with <br /> the City's Comprehensive Plan Land Use Element and the corresponding Medium - High Density <br /> Residential land use category. The uses within this district shall be consistent with, but may be <br /> more restrictive than the Medium - High Density Residential Land Use category permitted uses. <br /> B. Uses permitted.
