SECOND AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND HARBOUR CONSTRUCTION CONTRACT NO.C1213-060 This Second Amendment to*he Agreement between the City of Sunny Isles Beach and Harbour Construction, Inc., executed this 2-6 day of ud , 2013, is made a part of the original Agreement between the parties dated January 11, 2012 attached ereto as Attachment "A" and incorporated herein, between the City of Sunny Isles Beach ("City") and Harbour Construction, Inc., ("Contractor") a business corporation licensed in the State of Florida,whose Federal Identification# is. 1? 41o455 . The City and Consultant hereby agree as follows: 1. SERVICES TO BE PERFORMED. Pursuant to Section 3 of the Agreement,the City desires to retain the Contractor to remove certain objects and materials that were discovered after the initial demolition of the properties located on Sunny Isles Boulevard. The scope of services, as set forth in Section 2 of the Agreement, is hereby amended to include demolition of existing asphalt paving,curbing, tree(s), storm drain and water force main as more particularly described in Attachment "A" attached hereto and made part hereof. Contractor shall commence the permitting services described herein upon the issuance of Notice to Proceed by the City. 2. COSTS. The payments to the Contractor, as set forth in Section 4 of the Agreement, is hereby amended to include compensation for the demolition in an amount not to exceed Thirty Five Thousand Seven Hundred and Fifty Dollars($35,750.00)for the services to be performed, bringing the total amount not to exceed One Hundred Twenty Nine Thousand Seven Hundred Fifty Dollars($165,500.00). 4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the original Agreement between the parties, dated January 11, 2012, shall remain in full force and effect. All inclusions and exclusions included in proposal dated August 21, 2013 by Harbour Construction,Inc. shall be in effect.
