LPA RESOLUTION NO. 2013- '7 8 <br /> A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING <br /> TO THE CITY COMMISSION OF SUNNY ISLES BEACH, THE <br /> ORDINANCE AMENDING SECTION 265-36 NEIGHBORHOOD <br /> BUSINESS ZONING DISTRICT (B-1) TO DESIGNATE <br /> APARTMENT-HOTELS AS PROHIBITED USE; AMENDING <br /> SECTION 265-38 BUSINESS OVERLAY ZONING DISTRICT TO <br /> DELETE DEVELOLPMENT STANDARDS FOR APARTMENT- <br /> HOTELS, ATTACHED AS EXHIBIT "A"; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City Commission, serving as the Local Planning Agency ("LPA"), <br /> conducted a public hearing relating to the Land Development Regulations on December 10, 2002 <br /> and adopted the Land Development Regulations by Ordinance No. 2002-165; and <br /> WHEREAS, the City Commission, as the LPA, has reviewed the amendment to Sections <br /> 265-36 and 265-38 of the Land Development Regulations to ensure that apartment-hotels are • <br /> prohibited uses in Neighborhood Business (B-1) and Business Overlay Districts located in the <br /> City of Sunny Isles Beach to maintain lower density on the west side of Collins Avenue; and <br /> WHEREAS, the LPA has determined that it is in the best interest of the City and its <br /> residents to recommend approval of the Ordinance amending Sections 265-36 and 265-38 of the <br /> Land Development Regulations. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: <br /> Section 1. Recommendation: That the Local Planning Agency hereby recommends to the City <br /> Commission of the City of Sunny Isles Beach, the Ordinance amending Sections 265-36 and 265- <br /> 38 of the Land Development Regulations to ensure that apartment-hotels are prohibited uses in <br /> Neighborhood Business (B-1) and Business Overlay Districts located in the City of Sunny Isles <br /> Beach to maintain lower density on the west side of Collins Avenue, attached as Exhibit "A," for <br /> consideration by the City Commission pursuant to Chapter 163, Florida Statutes. <br /> Section 2.
