RESOLUTION NO. 13-Z-1-S-7 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ( "CITY ") APPROVING A SITE <br />PLAN MODIFICATION APPLICATION (Z2013 -01) SUBMITTED <br />BY ST. TROPEZ BEACH DEVELOPERS, LLC, PARQUE TOWERS <br />DEVELOPERS, LLC, AND ST. TROPEZ II, LLC (THE <br />"APPLICANT ") TO MODIFY THE SITE PLAN APPROVAL FOR <br />TWO (2) RESIDENTIAL TOWERS AND AN OFFICE BUILDING; <br />PROVIDING THE CITY MAiNrAGER AND CITY ATTORNEY <br />WITH THE AUTHORITY TO DO ALL THINGS \TCESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />I. RECITALS <br />WHEREAS St. Tropez Beach Developers. LLC, Parque Towers Developers, LLC, and <br />St. Tropez II, LLC (the "Applicant ") submitted a site plan modification of the approved site plan <br />under Resolution No. 12 -Z -133 adopted on November 15, 2012, requesting the following: <br />1. Pursuant to Section 265 -18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a site plan modification to increase the Floor <br />Area Ratio (FAR) from 637,887 to 692,526 square feet in the two residential <br />condominium towers approved under Resolution No. 12 -Z -133. <br />2. Pursuant to Section 265 -18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a site plan modification to increase the Floor <br />Area Ratio (FAR) from 55,749 to 95.345 square feet in the office building and to increase <br />the height of the office building to 152' -0" and thirteen (13) stories from 140' -0" and <br />eight (8) stories. <br />3. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit an average building height <br />Of 214' -2" where a maximum of 200' -0" is allowed in accordance with Section 265 -37 <br />F.(9)(a)[1] of the Land Development Regulations. <br />4. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a building height adjacent to <br />Collins Avenue (Phase III) to be 152' -0" where a maximum of 140' -0" is allowed in <br />accordance with Section 265 -37 F.(9)(a)[ 1 ] of the Land Development Regulations. <br />5. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance for the condominium towers in Phase <br />II to permit a pedestal front setback to be 0' -0 ", where a minimum of 15' -0" is required in <br />accordance with Section 265 -37 F. (6) (a) [1][a] of the Land Development Regulations. <br />6.
