IIl. FINDINGS AND CONCLUSIONS: <br />Based on an analysis of the application and the standards for approval for a site plan <br />modification under the Land Development Regulations, the City Commission makes the <br />following findings and conclusions: <br />A. The City Commission finds that the Applicant's variance requests to be consistent with <br />the requirements to grant a variance under the Land Development Regulations. <br />IV. APPROVAL <br />1. The Applicant's site plan application for the Project known as "Dezer Office Tower" <br />consisting of a 17 -story office/commercial building with a total FAR of 146,250 <br />square feet is hereby granted subject to the conditions in Section V below. <br />2. The Applicant's request to approve the utilization of development rights from a <br />private TDR Bank account in the amount of 33,750 square feet of development rights <br />for the office/commercial building is hereby granted subject to the conditions in <br />Section V below. <br />3. The Applicant's variance requests for the pedestal, front, and side setbacks are hereby <br />granted subject to the conditions in Section V below. <br />4. The Applicant's request for the use of graphics and murals on a temporary <br />construction fence is hereby granted subject to the conditions in Section V below. <br />V. <br />A. CONDITIONS TO BE COMPLETED BEFORE DEMOLITION. BELOW GRADE <br />OR BUILDING PERMITS ARE ISSUED. <br />1. That the plans in the approval be substantially in accordance with that submitted for <br />public hearing, which are entitled "Dezer Office Tower', prepared by Slattery & <br />Associates consisting of 21 sheets stamped date received October 11, 2013; the survey <br />entitled "Land Title Survey', prepared by Fortin, Leavy, Skiles, Inc., consisting of 1 <br />sheet updated on July 9, 2013; the Civil Plan prepared by Fortin, Leavy, Skiles, Inc <br />consisting of 2 sheets stamped date received October 11, 2013; and, the landscape plans <br />by Wayne Villavaso Landscape Architecture Inc. consisting of 2 sheets stamped date <br />received October 11, 2013. <br />2. If applicable, a Miami -Dade County tree removal permit must be secured and attached to <br />the landscape permit application prior to demolition. <br />3. Palms along Collins Avenue must be at least 12' clear -wood Medjool Palms to be <br />consistent with the City Streetscape Master Plan. <br />4. That the Applicant provides the Signage and Pavement Marking Plan prior to building <br />permit. <br />13-Z- h8 Dezer Office Tower 3 <br />
