RESOLUTION NO. 2013- z ( 5 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, GRANTING AN EASEMENT TO FLORIDA POWER & LIGHT (FPL) TO ALLOW FOR THE UNDERGROUNDING OF THE OVERHEAD WIRES ON THE SOUTH SIDE OF POINCIANA DRIVE FROM COLLINS AVENUE TO THE WATER (ICW PARK), ATTACHED HERETO AS EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is constructing Intracoastal Park located on Collins Avenue; and WHEREAS, there are existing overhead wires along the south side of Poinciana Drive from a concrete pole at Collins Avenue to the meter and panel located at the northwest corner of the Park site; and WHEREAS, this electrical service point feeds the up- lights for the Date Palms along Collins Avenue and will be expanded for future electrical needs at the Intracoastal Park; and WHEREAS, for aesthetic purposes only, the City wishes to have these overhead lines buried, and WHEREAS, Florida Power & Light (FPL) requires an Easement in order to accomplish this work; and WHEREAS, the City wishes to grant the Easement, attached hereto as Exhibit "A ", to FPL to perform said work. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby confirmed as being true and the same are hereby made part of this Resolution. Section 2. Approval of Granting an Easement. The City Commission of the City of Sunny Isles Beach hereby grants the Easement to Florida Power & Light to allow for the undergrounding of the overhead wires on the south side Poinciana Drive from Colliins Avenue to the water, attached hereto as Exhibit "A ".
