American Federated Title Corporation <br />3850 Hollywood Boulevard, Suite 400 <br />Hollywood, Florida 33021 <br />If to Subtenant: Beach Bar @ Newport Pier <br />ATTN: Paul Flanigan <br />1015 SE 16th Street <br />Fort Lauderdale, FL 33316 <br />Any party may change its address for Notices by Notice to the other party. The aforesaid attorneys <br />for the parties hereto are hereby respectively authorized to give any Notice permitted under this <br />Sublease. Any Notice given as provided herein shall be deemed received as follows: if delivered <br />by personal service, on the date so delivered; if delivered to an overnight courier service, on the <br />business day immediately following delivery to such service; and if mailed, on the third business <br />day after mailing. Rejection or other refusal to accept or the inability to deliver any Notice because <br />of a changed address of which no Notice was given shall be deemed to be receipt of the Notice <br />sent. <br />Any Notices required under Section 83.20, Florida Statutes, shall be deemed to have been <br />fully given, made, sent, and received if sent in compliance with this section. <br />25. Radon Gas. Subtenant is hereby advised that radon is a naturally occurring radioactive gas <br />that, when it has accumulated in a building in sufficient quantities, may present health risks to <br />persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines <br />have been found in buildings in Florida. Additional information regarding radon and radon <br />testing may be obtained from your county public health unit. The foregoing disclosure is provided <br />to comply with state law and is for informational purposes only and does not create any <br />representation, warranty, liability or obligation of Sublessor. <br />26. Estoppel Certificates. From time to time, Subtenant, within five (5) days' after written <br />request therefor from Sublessor, shall execute and deliver to Sublessor an estoppel certificate in a <br />form generally consistent with the requirements of institutional lenders or as otherwise required <br />by Sublessor or Landlord and certified to Sublessor, Landlord, and any lender, purchaser, or <br />prospective purchaser of the interest of Sublessor. In addition, if requested, Subtenant shall <br />provide any financial information concerning Subtenant and Subtenant's business operations that <br />may be reasonably requested by Sublessor, Landlord or any lender, purchaser, or prospective <br />purchaser of the interest of Sublessor. Any such statement, delivered pursuant to this Sublease <br />may be relied upon by Sublessor, Landlord, and any owner, prospective purchaser, lender, or <br />prospective lender. <br />27. Subordination. This Sublease and all of Subtenant's rights hereunder are subject and <br />subordinate to the Prime Lease and all ground or underlying leases, and mortgages which may <br />now or hereafter affect the Project or the real property on which the same is situate or any interest <br />therein, to all renewals, modifications, consolidations, replacements and extensions thereof, and to <br />16 <br />
