Summary Minutes: Regular City Commission Meeting October 17. 2013 City of Sunny Isles Beach, Florida <br />pleased with the way the concept of Sunny Isles Boulevard has finally evolved from what it <br />was back in 1997 when we incorporated to where we are today. He thinks we will be very <br />proud of what currently exists on Sunny Isles Boulevard which is a greater increase in the <br />quality of life for the people who are living here. <br />City Attorney Ottinot reiterated that the motion was to approve the Application with the <br />height variance and deny the setback variances. <br />Commissioner Gatto moved and Vice Mayor Aelion seconded a motion for approval, <br />subject to staff conditions. Request of Dezer Office Tower for the Property Located at 18080 Collins Avenue. to <br />Consider the Following: (Hearing M013 -02) <br />The Applicant is requesting site plan approval for a 17 -story office /commercial building with <br />a total of 146,250 square feet of Floor Area Ratio (FAR). The Applicant is requesting a <br />Transfer of Development Rights (TDRs) in the amount of 33,750 square feet from private <br />TDR Bank accounts. The Applicant is also seeking approval for interior side setbacks (north <br />and south) and front setback (tower and penthouse) variances. <br />1. Pursuant to Section 265 -18 of the City of Sunny Isles Beach Land Development <br />Regulations; the Applicant is requesting Site Plan Approval for a 17 -ston <br />office /commercial building with a total FAR of 146,250 square feet. <br />2. Pursuant to Section 265 -23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting to approve the utilization of TDRs from a private <br />TDR Bank account in the amount of 33,750 square feet of development rights for the <br />office /commercial building. <br />3. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a north pedestal side setback <br />to be S -0 ", where a minimum of 10' -0" is required within the Business Overlay District <br />under Section 265 -38 E.(5)(c) of the Land Development Regulations. <br />4. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a south pedestal side setback <br />to be 5 °- 0 ", where a minimum of 10' -0" is required within the Business Overlay District <br />under Section 265-38 E.(5)(c) of the Land Development Regulations. <br />5.
