quarantine restrictions, strikes, freight embargoes, and unusually severe weather; but in every case <br /> the failure to perform must be beyond the control and without any fault or negligence of VENDOR. <br /> (d) The rights and remedies of CITY provided for in this Section arc in addition and <br /> supplemental to any and all other rights and remedies provided bylaw or under this Agreement. <br /> Section 9. Agreement and Purchase Order in Conflict. Whenever the terms of this <br /> Agreement conflict with any Purchase Order issued pursuant to it,this Agreement shall prevail. <br /> Section 10. Equal Opportunity Employment. No Contingent Fees. VENDOR warrants that it has not employed or retained <br /> any company or person other than a bona fide employee working solely for VENDOR to solicit or <br /> secure this Agreement and that it has not paid or agreed to pay any person,company, eorpc ration, <br /> individual or firm other than a bona fide employee working solely for VENDOR any fee, <br /> commission, percentage, gift or other consideration contingent upon or resulting from award or <br /> making of this Agreement.
