The City will be proud to have us in their corner on any litigationto which the City might become involved.Short-term RentalsWe know that the City, like many Florida local governments, has been dealing with theissue of short-term rentals. The Firm recently assisted Flagler County in the preparation of theirshort-term regulation ordinance and successfully defended the ordinance through a legalchallenge. That experience could prove very valuable to the City in its ongoing deliberation ofthis issue.Our Approach to Legal ServicesNG&N proposes to provide legal services to the City by means of a contractualrelationship. Our approach to serving local government entities/ including municipalities/ is thatwe represent the City, not the Mayor or individual City Commission Members, the City Manageror staff. Our job is to provide exceptional and professional legal advice, both in terms of theapplication of the law to a given set of circumstances, but also in identifying "potholes" or areaswhere, if no corrective action is taken, legal liability or damage to the City's interest couldresult. We take this responsibility and are the City's advocate, but we also recognize that ourrole is neither to develop policy or implement it, and we take great pains not to overstep ourbounds as the City's legal counsel. In our past and current experience we have worked wellwith all parties, including elected officials and staff, by providing only professional legal adviceand not taking "sides" in policy or implementation disputes. Our objective as the City's legalcounsel is to provide timely and competent legal advice to the City, to keep (to the best of ourability) the City from incurring liability, and to vigorously and aggressively defend the City whenits interests are threatened. If we do our job, others are better able to do their jobs, and we cansave the City time and money that otherwise would have to be spent on non-productivematters. For example, we believe NG&N, by helping to legally restructure Okaloosa County'stourism development efforts after a prior director embezzled funds/ helped save our clienthundreds of thousands of dollars. Likewise, our efforts on behalf of Flagler County in the shortterm rentals issues described above we believe helped preserve substantial funds that could bedirected to governmental purposes. If selected we will work closely with the Mayor, the CityCommission, the City Manager and the City staff to further the City's interests. While we arenot a "go-between", we've found in other circumstances that we can help bridge differencessimply by pointing out the legal obstacles or likely outcomes if certain actions are taken. Wetake pride in our job and do it well.We need adequate information to appropriately provide legal counsel, but we'regenerally effective in getting what we need. For instance/ we need to be fully informed aboutall aspects of litigation matters in order to effectively represent the City in litigation.
