Statement of Malpractice Claims / Bar Complaints <br />Listed below are a summary of the malpractice claims and/or bar complaints taken on the Firm <br />and/or its attorneys during the last five years: <br />Lawsuits <br />1. George Pierson, William Mantesta vs. Weiss Serota Helfman Cole & Bierman, P. L. and <br />Jamie Cole; Broward County, Florida Case No. 16-011927. This case concerned an <br />allegation that the Firm improperly represented both the City of Miramar and several of its <br />former police officers in an action brought by an individual for false arrest. After <br />discovery, the plaintiff determined that the case was not viable and it was settled by the <br />Firm's insurance company for a small amount. In connection with the settlement, the <br />plaintiffs agreed that, based on discovery, there did not appear to be any evidence that the <br />Firm's representation constituted a conflict of interest or that its representation fell below <br />the applicable standard of care. <br />2. Dr. James Eric McDonough, Individually and in his capacity as an investigative journalist <br />for photographyisnotacrime.com vs. Eric Stettin, individually and in his capacity as <br />attorney for the City of Homestead, Samuel Zeskind, individually and in his capacity as <br />attorney for the City of Homestead; Weiss Scrota Helfman Cole & Bierman, a Corporation <br />in the State of Florida; and the City of Homestead a Florida Municipal corporation <br />collectively; Miami -Dade County Case No. 17- 17151 CAO 1. In this case, plaintiff asserted <br />that the City of Homestead's specific responses to nine of his over one hundred records <br />requests purportedly violated Chapter 119, the Public Records Law and that various City <br />employees (including City Manager Gretsas, Police Chief Rolle And City Clerk Sewell) <br />and our Firm (including two of its attorneys, Sam Zeskind and Eric Stettin) violated the <br />Miami -Dade County Charter by allegedly making misrepresentations. On May 21, 2018, <br />the Complaint against the Firm and its attorneys was dismissed with prejudice in its <br />entirety. <br />3. Raz�l Pedraza vs. Lawrence Slade &Weiss Ser•ota Helfman; Superior Court of California <br />case # BC 722353. Complaint for damages arising from one of our attorneys referring Mr. <br />Pedraza's California matter to a California Attorney who appears to have missed deadlines. <br />On February 8, 2019, the Complaint was served on the Firm. <br />Bar Complaints <br />1. Barbara Sheheen against Stephen Helfman; Florida Bar File 2019-70,394 (11B) filed <br />December 27, 2018. Disposition Mr. Helfman replied to the complaint on February 14, <br />2019, and we fully expect the complaint to be dismissed. The complaint is currently <br />pending before the Florida Bar. <br />
