RESOLUTION NO. 2019 - 29 33 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF <br /> POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME <br /> CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS <br /> FROM THE DEPARTMENT OF JUSTICE (DOJ) FOR THE <br /> INSTALLATION OF TEN (10) LICENSE PLATE READER SYSTEM <br /> CAMERAS, TWO (2) BOAT ENGINES FOR THE MARINE PATROL, <br /> AND LAW ENFORCEMENT AWARD MATERIALS, IN AN AMOUNT <br /> NOT TO EXCEED TWO HUNDRED SIXTY-ONE THOUSAND SIX <br /> HUNDRED FIFTY-EIGHT DOLLARS AND FIFTY CENTS($261,658.50); <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City <br /> and its Police Department are authorized to expend forfeiture funds from the established Department <br /> of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to <br /> enhance law enforcement purposes; and <br /> WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br /> Statutes §932.7055(5)(b) upon the request of,the Chief of Police to the governing body of a <br /> municipality, liens and forfeiture funds may be expended if accompanied by written certification that <br /> the request complies with the provisions of the aforementioned subsections; and <br /> WHEREAS, the Chief of Police has submitted a request for the installation of ten (10) <br /> license plate reader system cameras,two(2)boat engines for the marine patrol,and law enforcement <br /> award materials, in an amount not to exceed Two Hundred Sixty-One Thousand Six Hundred Fifty- <br /> Eight Dollars and Fifty Cents ($261,658.50) in forfeiture (DOJ) funds in compliance with the <br /> aforementioned legal requirements. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, <br /> the Chief of Police is hereby authorized to spend up to Two Hundred Sixty-One Thousand Six <br /> Hundred Fifty-Eight Dollars and Fifty Cents from the established Department of Justice (DOJ) <br /> federal forfeitures account for the installation of ten(10)license plate reader system cameras,two(2) <br /> boat engines for the marine patrol, and law enforcement award materials. <br /> Section 2. Effective.Date.
