The affidavit or releases shall certify that said subcontractors and suppliers have been paid their proportionate share of all previous partial payments to the awarded Bidder. In the event such affidavits cannot be furnished, the awarded Bidder may submit an executed consent of surety to requisition payment, identifying the subcontractors and suppliers with the amounts for which the statement of satisfaction cannot be furnished. If the awarded Bidder fails to provide a consent of surety to requisition payment, the amount in dispute will be withheld until either the statement of satisfaction is furnished, or the consent of surety to requisition payment is furnished. 2.21 BID BOND All offers shall be accompanied by a Bid Bond in the form of a Certified Check, Cashier's Check or Bid Bond in the amount of Five Percent 5% of the bid, payable to the City of City of Sunny Isles Beach, Florida. Subsequent Contract award shall be conditioned upon the Bidder recommended for award submitting all required documentation to complete the award process. Any offer which is not accompanied by this Bid Bond shall be considered unacceptable and/or non-responsive and ineligible for award. In case of failure or refusal by the recommended Bidder to complete the Contract award process, the security submitted with the offer shall be forfeited as liquidated damages because of such failure or default. All Bidders shall be entitled to the return of their Offer Guaranty/Bid Bond within ten (10) calendar days after execution of a Contract between the awarded Bidder and the City of Sunny Isles Beach. 2.22 INSURANCE 2.22.1 Comprehensive General Liability Insurance General Liability for Bodily Injury&Property Damage with limits of$1,000,000 per occurrence and $2,000,000 annual aggregate on a primary and non-contributory basis, , including the City of Sunny Isles Beach as Additional Insured, with a Waiver of Subrogation to the City and a Hold Harmless Agreement in accordance with City's legal advisor to be included. Coverage must be offered in a form no more restrictive than the latest edition of the Comprehensive General Liability policy, without restrictive endorsements, as filed by the Insurance Services Office, and shall specifically include the following with minimum limits not less than those required for Bodily Injury Liability and Property Damage Liability: • Premises and Operation; • Independent Contractors; • Products and/or Completed Operations Hazard; • Broad Form Property Damage; • Broad Form Contractual Coverage applicable to this specific Contract, including any hold harmless and/or indemnification agreement. • Personal Injury Coverage with Employee and Contractual Exclusions removed,with minimum limits of coverage equal to those required for Bodily Injury Liability and Property Damage Liability.
