RESOLUTION NO. 2014 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, REQUESTING THE <br />DEMOLITION OF AN UNFINISHED STRUCTURE LOCATED AT <br />15701 COLLINS AVENUE SUBJECT TO THE CONDITIONS SET <br />FORTH IN THIS RESOLUTION; PROVIDING THE CITY <br />MANAGER AND THE CITY ATTORNEY TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the unfinished structure commonly called Mansiana/Solis located at 15701 <br />Collins Avenue has been an eyesore in the City for many years; and <br />WHEREAS, the properly located at 15701 Collins Avenue has been purchased by a new <br />owner who is seeking to develop the property: and <br />WHEREAS, the City Commission wishes to provide incentives to the new owner to <br />demolish the unfinished structure. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incentives for Demolition. The City Commission hereby authorizes the City <br />Manager or designee to provide a credit for payment of Transfer of Development Rights or bonus <br />payments up to the sum of $250,000.00 or a donation of up to 4000 sq. ft. of TDRs to the owner <br />or developer of the property located at 15701 Collins Avenue subject to the conditions below. <br />Such credit shall be provided if the site plan is approved for the property located at 15701 Collins <br />Avenue. <br />Section 2. Conditions for Awarding of Credit. The owner or developer of the property <br />located at 15701 Collins Avenue shall comply with the following conditions: <br />(1) Obtain all necessary permits for demolition no later than May 1, 2014; <br />(2) Owner or developer shall commence demolition of the unfinished structure no later <br />than June 1, 2014; <br />(3) If the owner or developer Fails to comply with the conditions herein, the credit shall be <br />null and void. No credit shall be provided if the site plan is not approved for the <br />property located at 15701 Collins Avenue; <br />(4) The credit above shall be provided at the time of completion as approved by the City's <br />Building Department, and <br />(5) That the adjacent property owner, Tropicana Condominium Association, be added as <br />additional insured to the owner or developer's insurance policy to cover any damages <br />they may incur during the demolition of the structure located at 15701 Collins <br />Avenue. A copy of the insurance certificate shall be provided to representatives of <br />Tropicana Condominium Association. <br />Page i orz <br />
