Summar Minutes:Regular City Commission Meeting March 20,2014 City of Sunny Isles Beach,Florida <br /> fence was going to come down, it was your fence not the fence on the private property. <br /> Assistant City Manager Evans said that is correct, it is the fence that borders the Public <br /> Works compound. Commissioner Levin said there is the fence that belongs to the three <br /> buildings, there is the gravity wall, there is the asphalt, and then there is another fence that <br /> the City put up, and you are saying that whole parking area there, is that the Public Works <br /> property that you are referring to? Assistant City Manager Evans said that is correct. <br /> Commissioner Scholl said what he is hearing is that if the fence is on private property it <br /> won't come down because it is not Public Works' fence to take down. Assistant City <br /> Manager Evans said what we don't want to do is to have a wall and two fences. We are <br /> taking our fence down which is on FDOT property,and the area between the two we will put <br /> filter fabric in there, and we will put rock down to create a no maintenance area, realizing <br /> that we may still have to get back there at some date if anything happens like graffiti so they <br /> can take care of it,which is in the contract. City Manager Russo asked if that rock also helps <br /> with the drainage, and Assistant City Manager Evans said yes, everything is going to be <br /> graded to the Intracoastal and there is a drainage system underneath the wall itself. <br /> Commissioner Levin said when you come around behind Ocean Reserve, there is that <br /> sidewalk there when you are in between Lehman and the wall that is already there that holds <br /> the causeway up,people are going to still be able to walk through there? How are the people <br /> going to go to the other side of the wall, does the wall go all the way down, and are people <br /> going to be able to walk behind the wall? Assistant City Manager Evans said no,the people <br /> cannot walk behind the wall, there will be an access gate there and we are going to do a <br /> direct purchase on that. We met with the property managers over there, we talked about it, <br /> and we said we would leave that up in the air until we get to that, if the City was going to <br /> purchase the 12-foot gate in-house. Vice Mayor Aelion said when something comes before <br /> the Commission that has a dollar value to it,understandably the plans including drawings and <br /> everything has to be something of a finalized version. <br /> Commissioner Scholl said he would make the motion subject to the fact that we don't require <br /> an easement, we are on FDOT property, we are not encroaching on the Condominium's <br /> property, and we are not removing any improvements on the Condominium's property. <br /> Commissioner Scholl moved and Vice Mayor Aelion seconded a motion to approve the <br /> resolution. Resolution No. 2014-2210 was adopted by a voice vote of 5-0 in favor. <br /> 10B. A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Ratifying a <br /> Payment to Beiswenger, Hoch and Associates, Inc. (BH&A), to Provide Post Design <br /> Services for the Sunny Isles Beach /Newport Fishing Pier, in an Amount Not to Exceed <br /> $9,500.00; Authorizing the City Manager to Do All Things Necessary to Effectuate this <br /> Resolution; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Assistant City Manager Evans reported. <br /> Public Speakers: None <br /> Commissioner Scholl moved and Vice Mayor Aelion seconded a motion to approve the <br /> resolution. Resolution No. 2014-2211 was adopted by a voice vote of 5-0 in favor. <br /> 11 <br />
