RK OF COURT MIA111-DAI: E C:OUNTYe FLORIDA (Space Reserved for Clerk of Court) THIS UTILITY EASEMENT AGREEMENT (this "Agreement") is made and entered into as of V i r day of tA1 z 2019, by and between Winston Towers 600 Condominium Association, Inc., a Florida not for profit corporation ("Grantor"), having an address of c/o Management Office, 210 170' Street, Sunny Isles Beach, Florida, 33160, and The City of Sunny Isles Beach, a Municipal corporation existing under the laws of the State of Florida ("Grantee"), having an address of c/o City Manager, 18070 Collins Avenue, Sunny Isles Beach, Florida 33160. RECITALS: WHEREAS, Grantor is the owner of a certain property situated in Sunny Isles Beach, Miami -Dade County, Florida, and more particularly described in Exhibit "A" (the "Easement Parcel") attached hereto; and WHEREAS, Grantee is seeking to construct a Pedestrian Overpass Bridge connecting west side of Collins Avenue to the east side of Collins Avenue to be used for pedestrians (the "Pedestrian Bridge"); and WHEREAS, Grantor has agreed to grant and create, and Grantee, desires to obtain, on the terms and condition hereinafter set forth, an easement over, across, and under and through the Easement Parcel for the purposes of installing, maintaining and repairing all necessary utility lines, pipes, services and appurtenances which will serve the Pedestrian Bridge. NOW THEREFORE, in consideration of ten ($10.00) dollars and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor and Grantee hereby agree as follows: 1. Recitals. The foregoing recitals are true and correct and are incorporated herein as if repeated at length.
