F`L.OR:EDA <br />PERMANENT EASEMENT AGREEMENT <br />THIS PERMANENT EASEMENT AGREEMENT (this "Agreement") is made and <br />entered into as of 745day of June, 2019, by and between Winston Towers 600 Condominium <br />Association, Inc., a Florida not for profit corporation ("Grantor") having an address of c/o <br />Management Office, 210 174t" Street, Sunny Isles Beach, Florida, 33160, and The City of <br />Sunny Isles Beach, a Municipal corporation, existing under the laws of the State of Florida <br />("Grantee"), having an address of c/o City Manager, 18070 Collins Avenue, Sunny Isles Beach, <br />Florida, 33160. <br />RECITALS: <br />WHEREAS, Grantor is the owner of a certain property situated in Sunny Isles Beach, <br />Miami -Dade County, Florida, and more particularly described in Exhibit "A" attached hereto <br />(the "Easement Parcel"); and <br />WHEREAS, Grantee is seeking to construct a Pedestrian Overpass Bridge connecting <br />the west side of Collins Avenue to the east side of Collins Avenue to be used for pedestrian <br />ingress and egress (the "Pedestrian Bridge"); and <br />WHEREAS, Grantee requires a permanent easement for the site of the Pedestrian <br />Bridge; and <br />WHEREAS, Grantor has agreed to grant and create, and Grantee desires to obtain an <br />easement, on the terms and conditions hereinafter set forth in this Agreement. <br />NOW THEREFORE, in consideration of Ten ($10.00) Dollars and for other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor <br />and Grantee hereby agree as follows: <br />1. Recitals. The foregoing recitals are true and correct and are incorporated herein as if <br />repeated at length. <br />2. Easement Parcel. The legal description and sketch of the Easement Parcel is attached <br />
