Litigation Statement <br />Presented below is a summary of the litigation action which has been filed against H&H in the last five (5) <br />years: <br />•Hardesty & Hanover is presently involved in an arbitration-type proceeding in Copenhagen <br />involving a dispute between the contractor, the City of Copenhagen and the Prime Designer <br />(COWI). We are a subconsultant responsible for the design of mechanization systems of this <br />movable bridge project. The matter is ongoing. <br />•Plaintiff Uni-Systems, LLC filed a complaint against seven co-defendants, including Hardesty & <br />Hanover, LLC and Hardesty & Hanover, LLP in Federal Court (Eastern District of New York) alleging <br />patent infringement and trade secret misappropriation as related to the design and construction <br />of a retractable roof for the U.S. Tennis Center. This is a recently received complaint and the <br />matter is ongoing. <br />•A general contractor, Conway Construction Company, filed action against Multnomah County and <br />Zellcomp, Inc. in the Circuit Court of the State of Oregon, for matters related to the performance <br />of the bridge deck system supplied by Zellcomp. Hardesty & Hanover provided minimal consulting <br />services for Zellcomp and was added as a defendant. H&H’s contract amount for services <br />rendered was roughly $40,000. The construction cost of the project was $4 million. H&H settled <br />with the County for a total of roughly $1 million in 2015. <br />•A general contractor, J.H. Reid, filed action against NJDOT seeking damages in the Superior Court <br />of New Jersey, Monmouth County, Law Division in connection with the Route 36 Highlands Bridge <br />over the Shrewsbury Bridge Replacement Project. Jacobs Engineering, Engineer of Record, filed a <br />third-party complaint against Hardesty & Hanover in 2011. As a subconsultant, Hardesty & <br />Hanover provided bridge design services to Jacobs Engineering. The matter was settled in 2015 <br />for roughly $50,000. The construction cost of the project was $125 million. H&H’s contract <br />amount for services rendered was roughly $4.5 million. <br />Hardesty & Hanover has not been debarred or suspended from bidding or proposing on a procurement <br />project by any government entity during the last five (5) years. <br />I-1
