AGREEMENT <br />BETWEEN THE <br />CITY OF LAUDERHILL <br />AND <br />ROSS ENGINEERING, INC <br />FOR <br />MISCELLANEOUS PROFESSIONAL SERVICES <br />THIS AGREEMENT (“Agreement”), effective on the date of the last party to sign below, <br />is between the City of Lauderhill, a Florida municipal corporation, (“CITY”), and Ross <br />Engineering, Inc (“CONSULTANT”) for Cost Estimating/ Value Engineering <br />(“Agreement”). References in this Agreement to “City Manager” shall be meant to <br />include his designee. <br />WITNESSETH: <br />WHEREAS, the City of Lauderhill issued a Request for Qualification (RFQ) 2019-057 <br />for Miscellaneous Professional Services, pursuant to Section 287.055, Florida Statutes, <br />and established a Selection Committee for the purpose of recommending to the City <br />Commission the selection of a firm to perform plan review and inspection services, a <br />copy of RFQ 2019-057 is attached hereto an incorporated by reference as Exhibit A; and <br />WHEREAS, the CONSULTANT submitted a response to RFQ 2019-057 and the <br />CONSULTANTS proposal is attached hereto and incorporated by reference as Exhibit B; <br />and <br />WHEREAS, on February 10, 2020, the City Commission adopted Resolution No. 20R- <br />02-048, which ratified the rankings of the Selection Committee and authorized the City <br />officials to enter into negotiations for an agreement with the top ranked proposer; a copy <br />of Resolution 20R-02-48 is attached hereto and incorporated by reference as Exhibit C; <br />and <br />WHEREAS, CITY and CONSULTANT desire to enter into an Agreement whereby the <br />duties and obligations each to the other are set forth. <br />IN CONSIDERATION OF THE MUTUAL COVENANTS AND CONDITIONS <br />HEREIN EXPRESSED AND THE FAITHFUL PERFORMANCE OF ALL SUCH <br />COVENANTS AND CONDITIONS, THE PARTIES AGREE AS FOLLOWS: <br />Page 83
