<br /> <br /> <br />City of Sunny Isles Beach | ITB 20-08-01 City Landscaping Services 20 <br /> <br /> <br />No contract will be awarded to, any person who is in arrears to the City of Sunny Isles Beach, upon <br />any debt or contract, or who has defaulted, as surety or otherwise, upon any obligation to any <br />public agency, or who is deemed irresponsible or unreliable by the City Commission of the City of <br />Sunny Isles Beach, in its sole discretion. <br /> <br />2.6 MULTIPLE AWARD <br /> <br />The City may award multiple Bidders (primary, secondary and tertiary) as available, by line item, <br />by group, or in its entirety. The City will endeavor to utilize Bidders in order of award. The lowest <br />Bidder for each group shall be considered the primary awardee and should receive the largest <br />volume of work, upon meeting the required qualifications and acceptance to the City’s terms. <br />However, the City may utilize other Bidders in the event that: 1) a contract Bidder is not or is <br />unable to be in compliance with any contract or delivery requirement; 2) it is in the best interest <br />of the City to do so regardless of reason. In the event that one of the successful bidders (primary, <br />secondary or tertiary) are deemed to be performing unsatisfactorily as determined by the City, the <br />City may opt to award their designated bid group to the Bidder performing to City’s approval. <br /> <br />2.7 MINORITY / WOMEN’S / LABOR SURPLUS FIRMS PARTICIPATION: <br /> <br />The City of Sunny Isles Beach, in accordance with the requirements as stated in C.F.R. 200.321 <br />encourages the active participation of minority businesses, women’s business enterprises and labor <br />surplus area firms as a part of any subsequent agreement whenever possible. If subcontracts are <br />to be let, through a prime contractor, that contractor is required to take the affirmative steps listed <br />in items (1) through (6) below: <br /> <br />(1) Placing qualified small and minority businesses and women's business enterprises on solicitation <br />lists; <br /> <br />(2) Assuring that small and minority businesses, and women's business enterprises are solicited <br />whenever they are potential sources; <br /> <br />(3) Dividing total requirements, when economically feasible, into smaller tasks or quantities to <br />permit maximum participation by small and minority businesses, and women's business <br />enterprises; <br /> <br />(4) Establishing delivery schedules, where the requirement permits, which encourage participation <br />by small and minority businesses, and women's business enterprises; <br /> <br />(5) Using the services and assistance, as appropriate, of such organizations as the Small Business <br />Administration and the Minority Business Development Agency of the Department of Commerce. <br /> <br />(6) Requiring the prime contractor, if subcontracts are to be let, to take the affirmative steps listed <br />in paragraphs (1) through (5) of this section. <br /> <br />2.8 NON-DISCRIMINATION AND EQUAL OPPORTUNITY EMPLOYMENT
