In situations where job responsibilities include regular driving and accepting of business calls, <br />hands-free equipment will be provided to facilitate the provisions of this policy. <br />Employees whose job responsibilities do not specifically include driving as an essential function, <br />but who are issued a cell phone for business use, are also expected to abide by the provisions <br />above. Under no circumstances are employees allowed to place themselves at risk to fulfill <br />business needs. <br />Employees who are charged with traffic violations resulting from the use of their phone while <br />driving will be solely responsible for all liabilities that result from such actions. <br />Violations of this policy will be subject to the highest forms of discipline, up to and including <br />termination. <br />9. GPS POLICY <br />Our company phones and radios carry abuilt-in GPS tracking system which will be used by the <br />company. GPS tracking technology allows us to track employees at any time. However, the <br />Company reserves the right to use such technology only throughout our regular business hours as <br />is defined by your job title. The Company has no interest in using, or intention to use, this device <br />and technology outside business hours and will not track its employees outside our regular <br />business hours. <br />The GPS tracking system will allow us to know when the employee started to work and when the <br />employee stopped working. The system will also inform us the address of the employee's <br />location at any time during working hours, and will reflect the employee's mileage. Additionally, <br />this technology will permit us to provide lost employees directions to their work sites as needed. <br />10. CRIMINAL CHARGES, ARRESTS, AND CONVICTIONS <br />You are required to immediately advise within 24 hours after being arrested, charged, and/or <br />indicted for the commission of, or participation in, a felony or misdemeanor (including criminal <br />traffic violations), for conduct occurring on or off-duty. ["Non -criminal traffic violations" do not <br />involve prosecuting authority and only a traffic citation is issued. Examples of "criminal traffic <br />violations" are reckless driving offenses, driving with suspended license, and driving "under the <br />influence."] Depending upon the nature and severity of the charge, you may be subject to <br />suspension pending the outcome of the charges and/or an investigation of the facts and <br />circumstances of the incident by the Company. Failure to advise The Human Resources <br />Representative in a timely manner may result in disciplinary action, up to and including <br />termination. <br />11. JURY DUTY <br />Employees have a legal and civic obligation to serve as jurors or witnesses if summoned or <br />subpoenaed to do so. If you receive a call to jury duty, please notify your manager and human <br />resources representative immediately and submit a copy of the summons to serve, so s/he may <br />plan the department's work with as little disruption as possible. <br />31 <br />
