RESOLUTION NO. 2020 - 311 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN <br />ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT <br />OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE <br />DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF EIGHT (8) <br />SOLAR POWERED TRAFFIC SIGNS AND FIELD FORCE EQUIPMENT, <br />IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY-FIVE <br />THOUSAND DOLLARS ($155,000.00); PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City <br />and its Police Department are authorized to expend forfeiture funds from the established Department <br />of Justice ("DOJ") federal forfeiture account, for the approved programs or purchases intended to <br />enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification that <br />the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request for the purchase of eight (8) solar <br />powered traffic signs and field force equipment, in an amount not to exceed One Hundred Fifty -Five <br />Thousand Dollars ($155,000.00) in forfeiture DOJ funds in compliance with the aforementioned <br />legal requirements. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached <br />certification, the Chief of Police is hereby authorized to spend up to One Hundred Fifty -Five <br />Thousand Dollars ($155,000.00) from the established Department of Justice federal forfeitures <br />account for the purchase of eight (8) solar powered traffic signs and field force equipment. <br />Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. <br />PASSED AND ADOPTED this 15t day of c ber 2020. <br />George H.
