THIRD AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND PERKINS & WILL ARCHITECTS INC CONTRACT NO.6009-062-01 This Third Amendment to the Agreement between the CITY OF SUNNY ISLES BEACH ("City" nd P CIN&& WILL ARCHITECTS, INC. ("Architect"), executed this day of _ .20 is made a part of the original Agreement between the parties dated May 21, 2018, Contract No. 6009-062, as amended (the "Agreement"), and the City and the Architect hereby agree to amend the Agreement as follows: 1. ADDITIONAL SERVICES. Pursuant to Section 1.3 of the Agreement, the parties hereby wish to amend Article 3 of the Agreement ("Architect's Basic Services") to include that the Architect shall provide new Fire Alar n plans, bringing the building up to current Fire Alarm Codes and add devices requested by Miami -Dade Fire Department, and providing (2) signed and sealed Fire Alann sets of drawings that will be submitted to Miami -Dade Fire Department as a permit revision, all as more particularly described in Attachment "A," which is attached hereto and incorporated herein by reference ("Additional Services"). 2. ADDITIONAL COMPENSATION. Article 2, Section 2.1 of the Agreement, providing for compensation for the Gateway Park Build -Out, is hereby amended to add additional compensation in an amount not to exceed Four Thousand Eight Hundred Dollars ($4,800.00) for the Additional Services, and additional compensation in an amount not to exceed Ten Thousand Two Hundred Dollars ($10,200.00) for allowable and approved Reimbursements as provided by Article 2, Section 2.3, and Article 8 of the Agreement. This Third Amendment thereby brings the total compensation for the Gateway Park Build -Out to Four Hundred Seventy -Five Thousand Dollars ($475,000.00). Article 2, Section 2.4 of the Agreement is hereby amended to reflect a revised total contract amount not to exceed to Four Hundred Seventy -Five Thousand Dollars ($475,000.00). 3. PAYMENTS. Article 9, Section 9.1, subsection A of the Agreement, entitled "Gateway Park Build Out" is hereby amended to reflect the total compensation of Four Hundred Seventy - Five Thousand Dollars ($475,000.00). 4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, all terms and conditions of the Agreement shall remain in full force and effect. 5. CONFLI.CTING PROVISIONS. The terms, statements, requirements, or provisions contained in this Third Amendment shall prevail and be given superior effect and priority over any conflicting or inconsistent terms, statements, requirements or provisions contained in any other document or attachment, including but not limited to Attachments "A".
