RESOLUTION NO. 2021 - —5 ((C-9 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, STRONGLY OPPOSING SENATE BILL 522 <br />AND HOUSE BILL 219, WHICH SEEK TO PREEMPT THE <br />REGULATION OF SHORT-TERM RENTALS TO THE STATE; <br />DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Senator Manny Diaz Jr. has filed Senate Bill 522 ("SB 522"), and <br />Representative Jason Fischer introduced House Bill 219 ("HB 219") for consideration during the <br />2021 Florida Legislative Session seeking to preempt the regulation of short-term rentals to the <br />State; and <br />WHEREAS, the City has determined that its short-term rental ordinance protects the <br />life, health, and safety of its residents and visitors; and <br />WHEREAS, the City Commission believes that regulation of short-term rentals is <br />essential to protecting the rights of property owners in the City to be free of the deleterious and <br />adverse effects of unrestrained short-term rentals; and <br />WHEREAS, in January of 2021, City staff identified 1,351 units actively advertising for <br />short-term rentals within the City, thus, the ability to regulate short-term rentals is an issue of <br />critical importance to the City; and <br />WHEREAS, the City Commission believes that issues of this nature should be determined <br />locally, in accordance with the City's home rule authority; and <br />WHEREAS, the Mayor and City Commission declare their strong opposition to SB <br />522 and HB 219, and any substitute or similar Senate or House bill which preempts the <br />authority of local municipalities to protect their citizens and preserve the integrity of its <br />communities. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Opposition to Senate Bill 522 and House Bill 219. The City Commission hereby <br />expresses its strong opposition to Senate Bill 522 and House Bill 219. <br />Section 2. Directions to the City Clerk. The City Clerk is hereby directed to distribute copies <br />of this Resolution to Senator Manny Diaz Jr., Representative Jason Fischer, Governor Ron <br />DeSantis, the Speaker of the Florida House of Representatives, the President of the Florida Senate, <br />the Florida League of Cities, and the Miami -Dade League of Cities. <br />Section 3.
