RESOLUTION NO. 2021 - 3110 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, ADOPTING THE TOWN CENTER NORTH <br />PUBLIC ENGAGEMENT REPORT PREPARED BY CALVIN, <br />GIORDANO & ASSOCIATES, INC., ATTACHED HERETO AS EXHIBIT <br />"A"; AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in 2019, the City of Sunny Isles Beach ("City") discovered an inconsistency <br />between its Comprehensive Plan (Town Center Overlay District) and Land Development <br />Regulations (Town Center Zoning District) affecting what is known as the Town Center District; <br />and <br />WHEREAS, upon realizing that its Comprehensive Plan was inconsistent with its Land <br />Development Regulations with respect to the Town Center District, the City began to take steps to <br />address the inconsistency; and <br />WHEREAS, on August 28, 2019, the City Commission adopted Resolution 2019-2967 <br />declaring zoning in progress relating to development and redevelopment in the Town Center Zoning <br />District; and <br />WHEREAS, on September 19, 2019, the City Commission adopted Ordinance 2019-541, <br />establishing a twelve (12) month moratorium on the submission and consideration of zoning <br />applications in the Town Center Zoning District; and <br />WHEREAS, on October 17, 2019, the City Commission passed Resolution 2019-3006, <br />adopting a schedule for bringing the City's Land Development Regulations into conformity with <br />the provisions of the recently adopted comprehensive plan ("Plan of Action"), as provided by <br />Florida Statute 163.3194(1)(b); and <br />WHEREAS, on December 19, 2019, the City Commission adopted on second reading <br />Ordinance No. 2019-549, adopting a comprehensive plan amendment which created a Town Center <br />South Overlay District and a Town Center North Overlay District and provided for density and <br />intensity only in the Town Center South Overlay District for the first time; and <br />WHEREAS, on December 19, 2019, the City Commission also adopted on second reading <br />Ordinance No. 2019-550 adopting a comprehensive plan map amendment which effectuated Future <br />Land Use Map (FLUM) Amendments to reflect the creation of the Town Center South Overlay and <br />the Town Center North Overlay and providing for land use designation amendments for certain <br />properties located in the Town Center South Overlay; and <br />WHEREAS, the land use overlay designation for Town Center North currently does not <br />include density or intensity parameters, therefore, the City engaged its consultant, Calvin, Giordano <br />& Associates, Inc. ("CGA") to provide a public engagement process with respect to the newly <br />created Town Center North Overlay land use district; and <br />WHEREAS, CGA has completed the public engagement process and has prepared a report <br />summarizing its findings, which is attached hereto as Exhibit "A" and incorporated herein by <br />reference; and <br />R2021 Adopt CGA TCND Public Engagement Report Page 1 of 2 <br />
