I. Application annulment. If an applicant fails to act upon a submitted application within a <br />ninety -day period after receiving written comments from the Zoning, Planning and Buiklit+g <br />Development Services Director, the application will be deemed null and void. ' <br />N. General development provisions. <br />(1) Time periods/expiration - completed application. A completed application (as <br />determined by the Zoning, Planning and Buikl n Development Services Director) for a <br />development order submitted after the effective date of these LDRs shall be valid for a <br />period of six months. The application shall expire on the six month anniversary of the <br />submission date of the application in the event a development order based upon said <br />application has not been obtained by said date. The application shall expire earlier in the <br />event of the final denial of the application prior to the expiration of the six-month period. <br />O. Zoning clearance shall be required for all buildings and structures hereinafter erected, <br />constructed, altered, or repaired within any zoning district established by the Land <br />Development Regulations, and for the use of vacant land or for a change in the character of <br />the use of land within any district established by the Land Development Regulations. No <br />building permit shall be issued until a zoning clearance memorandum has been issued by the <br />Direetor of Planning and Zoning Development Services Director or designee. <br />§ 265-13. - Conditional uses. <br />A. Purpose. Conditional uses are generally compatible with the other land uses permitted in a <br />zoning district but, because of their unique characteristics or potential impacts on the <br />surrounding neighborhood and the City as a whole, require individual review as to their <br />location, design, configuration, and/or operation for the particular use at the particular location <br />proposed, as well as the imposition of individualized conditions in order to ensure that the use <br />is compatible with the surrounding neighborhoods and appropriate at a particular location. <br />B. Applications requirements. No use designated, as a conditional use shall be established until <br />after such use has received approval under the provisions of this section and has received all <br />other permits required by these LDRs. An application for conditional use approval shall be <br />filed with the Depat4m epA of Zoning, Planning and Building Development Services Director <br />on forms provided and run concurrent with site plan approval. The application shall include: <br />(1) A site plan, meeting the technical requirements for a final site plan. <br />(2) An application fee, as may be established from time to time by the City Commission. <br />(3) A written and graphic summary of the proposed project. <br />(4) Ownership affidavit and owner's sworn to consent, if applicable. <br />(5) Current certified survey. <br />35 <br />
