RESOLUTION NO. 21-Z- 111 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH, FLORIDA, APPROVING THE APPLICATION FOR <br /> VARIANCE (APPLICATION NO. PZ2021-03) SUBMITTED BY VITALY <br /> PINCHUK (THE "APPLICANT") TO ALLOW FOUR (4) VARIANCES: <br /> (1) A SIDE SETBACK VARIANCE OF FIVE FEET (5') WHERE SEVEN <br /> AND ONE HALF FEET(7.5')IS REQUIRED ON THE EAST SIDE OF THE <br /> PROPERTY, (2) A SIDE SETBACK VARIANCE OF FIVE FEET (5') <br /> WHERE SEVEN AND ONE HALF FEET (7.5') IS REQUIRED ON THE <br /> WEST SIDE OF THE PROPERTY, (3) A POOL SIDE SETBACK OF <br /> SEVEN AND ONE HALF FEET (7.5') WHERE NINE AND ONE HALF <br /> FEET (9.5') IS REQUIRED, AND (4) A HEIGHT VARIANCE FOR THE <br /> ELEVATOR SHAFT AND ROOF TRELLISES NOT TO EXCEED <br /> THIRTY-NINE FEET AND TEN INCHES (39'-10") MEASURED FROM <br /> THE CROWN OF THE ROAD WHERE THIRTY-FIVE FEET (35') IS <br /> ALLOWED, AT THE SINGLE-FAMILY PROPERTY LOCATED AT 318 <br /> ATLANTIC AVENUE, SUNNY ISLES BEACH, FL 33160; PROVIDING <br /> THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br /> FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br /> FOR AN EFFECTIVE DATE <br /> WHEREAS, Vitaly Pinchuk (the "Applicant") submitted a zoning variance application, <br /> numbered PZ2021-03 (the "Application"), to the City of Sunny Isles Beach, Florida ("City") <br /> requesting the following: <br /> 1. Pursuant to Sections 265-31 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting a side setback variance to decrease the required <br /> side setback from seven and one half feet (7.5') to five feet (5') on the east side of the <br /> property; <br /> 2. Pursuant to Sections 265-31 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting a side setback variance to decrease the required <br /> side setback from seven and one half feet (7.5') to five feet (5') on the west side of the <br /> property; <br /> 3. Pursuant to Sections 265-31 and 265-45(I) of the City of Sunny Isles Beach Land <br /> Development Regulations, the Applicant is also requesting a pool side setback variance to <br /> decrease the required pool side setback from nine and one half feet(9.5') to seven and one <br /> half feet (7.5') on the east side of the property; and <br /> 4. Pursuant to Sections 265-31 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting a height variance for the elevator shaft and roof <br /> trellises which would increase the required height by an additional four feet and ten inches <br />
