And so he <br /> thinks that you have got to have some kind of penalty no matter what. What we are trying to <br /> propose here is a penalty that is not a hardship, it is a penalty that benefits the person, that <br /> benefits the City, and is not an out-of-pocket cost to anyone. <br /> Vice Mayor Aelion said he thinks it is imputative on our youth to encourage them through <br /> the educational program. Chief Maas said the preponderance on those that we would stop <br /> would be juveniles and without parental approval of any penalty of that moving forward,you <br /> would be dealing with the parents because if there is a challenge on any part there is going to <br /> have to be the parents that appear at a custodial meeting and so you may have a punishment <br /> meted out to any juvenile without parental approval. Mayor Edelcup said if a juvenile was <br /> acting in a reckless manner and not on a skateboard, you would have the same problem, <br /> would you not? Chief Maas said absolutely through the court system. If there is a challenge <br /> to the penalty that goes before the Hearing Master the parents would appear. <br /> Commissioner Levin added that we must do the educational program. She did suggest <br /> previously that maybe we should put together a brochure in 3 or 4 different languages to give <br /> to the parents to get them involved in talking to their children about it. Commissioner Gatto <br /> said she would like to propose deferring this to give the Chief an opportunity to think this <br /> through because it seems problematic on his end. Realistically whatever we vote on today <br /> falls on the shoulders of the Police Department and maybe we need to collaborate on it a <br /> little bit more. <br /> Mayor Edelcup said this is first readin g, rather than defer we can pass it on first reading and <br /> this still gives 30 days for the Chief to come back so we really have not lost the time, and <br /> Commissioner Gatto agreed. Commissioner Levin said we can pass this Ordinance and we <br /> can always un-pass the Ordinance later on if we find that it is not working. <br /> City Attorney Ottinot said there were some friendly amendments made: 1) the education <br /> requirement; 2) it won't take effect until 90 days after it is adopted; 3) take away the <br /> monetary penalty; and 4) the penalty would be community service. For clarification <br /> purposes, leave it up to the City Manager as to what form the community service will be. <br /> Commissioner Levin moved and Commissioner Gatto seconded a motion to approve the <br /> proposed Ordinance on first reading,as amended. The motion was approved by a roll <br /> call vote of 3-1-1 (Vice Mayor Aelion against; Commissioner Scholl absent) in favor. <br /> Second reading, public hearing will be held on Thursday, June 19, 2014, at 6:30 p.m. <br /> Vote: Commissioner Gatto yes <br /> Commissioner Levin yes <br /> Commissioner Scholl absent <br /> Vice Mayor Aelion No <br /> Mayor Edelcup yes <br /> City Attorney Ottinot said Commissioner Scholl had shared some comments with him and <br /> the City Manager about this Ordinance relating to Skateboards.
