<br />00700 - 1/38 <br /> SECTION 00700 - GENERAL CONDITIONS <br /> <br /> <br />ARTICLE 1 -- DEFINITIONS <br /> <br />Wherever used in these General Conditions or in the other Contract Documents the following <br />terms have the meanings indicated: <br /> <br />Addenda - Written or graphic instruments issued prior to the opening of Bids which make <br />additions, deletions, or revisions to the Contract Documents. <br /> <br />Agreement - The written contract between the OWNER and the CONTRACTOR covering the <br />Work to be performed; when other documents are attached to the Agreement they become part <br />of the contract. <br /> <br />Application for Payment - The form furnished by the ENGINEER which is to be used by the <br />CONTRACTOR to request progress or final payment and which includes such supporting <br />documentation as is required by the Contract Documents. <br /> <br />Bid - The offer(s) submitted in response to this Invitation for Bid. <br /> <br />Bonds - Bid, Performance, and Payment Bonds and other instruments which protect against <br />loss due to inability or refusal of the CONTRACTOR to perform its Contract. <br /> <br />Change Order - A document recommended by the ENGINEER, which is signed by the <br />CONTRACTOR and the OWNER and authorizes an addition, deletion, or revision in the Work, <br />or an adjustment in the Contract Price or the Contract Time, issued on or after the Eff ective <br />Date of the Agreement pursuant to Article 10. <br /> <br />Consultant - Engineer of Record or Owner’s Representative. <br /> <br />Contract Documents - The Notice Inviting Bids, Instructions to Bidders, Bid Forms (including the <br />Bid, Bid Schedule(s), Information Required of Bidder, Bid Bond, and all required certificates and <br />affidavits), Agreement, Performance Bond, Payment Bond, General Conditions, Supplementary <br />General Conditions, Technical Specifications, Drawings, and all addenda, and change orders <br />executed pursuant to the provisions of the Contract Documents. <br /> <br />Contract Price - The original amount established in the bid submittal and award by the City, as <br />may be amended by Change Order. <br /> <br />Contract Time - The original time between commencement and completion, including any <br />milestone dates thereof, established in the contract, as may be amended by Change Order. <br /> <br />CONTRACTOR - Anyone with whom the City has entered into a contractual agreement. <br /> <br />Cost of Work - Unit prices will be devised into two categories, LABOR and MATERIAL. Labor <br />units shall be inclusive of all work effort, equipment, temporary restoration, overhead and profit. <br />Material units shall be at actual cost inclusive of conduit, couplers, elbows, glue, end caps, pull <br />string / tape, and delivery charges based on Consumer Pricing Index effective August 1, 2021. <br />Subsequent evaluation of material costs will be accomplished every sixty (60) days after award <br />of contract to assess variances in Market Pricing for material. Equitable adjustments either <br />increase or decrease will be reflected in overall contract cost utilizing contract change order
