<br />00700 - 8/38 <br />is expressly provided in the Supplementary General Conditions and/or the <br />Section entitled "Protection of Existing Facilities" of the General Requirements, <br />the OWNER and the ENGINEER shall not be responsible for the accuracy or <br />completeness of any such information or data, and the CONTRACTOR shall <br />have full responsibility for reviewing and checking all such information and data, <br />and perform soft digs as required for locating all Underground Utilities shown or <br />indicated in the Contract Documents, for coordination of the Work with the <br />owners of such Underground Utilities during construction, for the safety and <br />protection thereof and repairing any damage thereto resulting from the Work, the <br />cost of which will be considered as having been included in the Contract Price. <br />The contractor must be equipped with all necessary tools and parts in order to <br />repair damaged underground utilities in timely matter. <br /> <br />B. Not Shown or Indicated: If an Underground Utility is uncovered or revealed at or <br />contiguous to the site which was not shown or indicated in the Contract <br />Documents and which the CONTRACTOR could not reasonably have been <br />expected to be aware of, the CONTRACTOR shall identify the owner of such <br />Underground Utility and give written notice thereof to that owner, and shall notify <br />the ENGINEER in accordance with the requirements of the Supplementary <br />General Conditions and Section entitled "Protection of Existing Facilities" of the <br />General Requirements. <br /> <br />4.4 REFERENCE POINTS <br /> <br />A. The CONTRACTOR shall furnish all lines, grades, and bench marks required for <br />proper execution of the Work including right-ow-way and property lines. <br /> <br />B. The CONTRACTOR shall preserve all bench marks, stakes, and other survey <br />marks, and in case of their removal or destruction by its own employees or by its <br />subcontractor's employees, the CONTRACTOR shall be responsible for the <br />accurate replacement of such reference points by professionally qualified <br />personnel. <br /> <br />4.5 ASBESTOS, HAZARDOUS WASTE, OR TOXIC OR RADIOACTIVE MATERIALS <br /> <br />A. If the CONTRACTOR observes, uncovers, or otherwise becomes aware of any <br />asbestos, hazardous waste, or toxic or radioactive material at the site to which <br />the CONTRACTOR or any Subcontractor, Supplier, or other person may be <br />exposed, the CONTRACTOR shall immediately notify the OWNER and the <br />ENGINEER and thereafter confirm any oral notice in writing. The OWNER will <br />promptly consult with the ENGINEER concerning such condition and determine <br />the necessity of OWNER's retaining special consultants or qualified experts to <br />deal therewith. The CONTRACTOR shall not perform any Work in connection <br />therewith prior to receipt of special written instructions from the OWNER through <br />the ENGINEER. <br /> <br /> <br /> <br /> <br /> <br /> <br />
