Except as otherwise provided in this Paragraph, the CONTRACTOR shall <br />receive no additional compensation for overtime Work, i.e., Work in excess of <br />eight (8) hours in any one calendar day or forty (40) hours in any one calendar <br />week, even though such overtime Work may be required under emergency <br />conditions and may be ordered by the ENGINEER in writing. Additional <br />compensation will be paid the CONTRACTOR for overtime Work only in the <br />event extra Work is ordered by the ENGINEER and the change order specifically <br />authorizes the use of overtime Work and then only to such extent as overtime <br />wages are regularly being paid by the CONTRACTOR for overtime Work of a <br />similar nature in the same locality. <br /> <br />C. All costs of inspection and testing performed during overtime Work by the <br />CONTRACTOR which is allowed solely for the convenience of the <br />CONTRACTOR shall be borne by the CONTRACTOR. The OWNER shall have <br />the authority to deduct the cost of all such inspection and testing from any partial <br />payments otherwise due to the CONTRACTOR. <br /> <br />D. Unless otherwise specified in the Contract Documents, the CONTRACTOR shall <br />furnish and assume full responsibility for all materials, equipment, labor, <br />transportation, construction equipment and machinery, instrumentation, <br />electronics, tools, appliances, fuel, power, light, heat, telephone, water, sanitary <br />facilities, and all other facilities and incidentals necessary for the furnishing, <br />performance, testing, start-up, and completion of the Work. <br /> <br />E. All materials and equipment to be incorporated into the Work shall be of good <br />quality and new, except as otherwise provided in the Contract Documents. All <br />Suppliers' warranties and guarantees specifically called for by the Specifications <br />shall expressly run to the benefit of the OWNER. If required by the ENGINEER, <br />the CONTRACTOR shall furnish satisfactory evidence (including reports of <br />required tests) as to the kind and quality of materials and equipment. All <br />materials and equipment shall be applied, installed, connected, erected, used, <br />cleaned, and conditioned in accordance with the instructions of the applicable <br />Supplier except as otherwise provided in the Contract Documents; but no <br />provisions of any such instructions will be effective to assign to the ENGINEER, <br />or any of the ENGINEER's consultants, agents, or employees, any duty or <br />authority to supervise or direct the furnishing or performance of the Work or any <br />duty or authority to undertake responsibility contrary to the provisions of <br />Paragraphs 9.9C and 9.9D. <br /> <br />F. For material provided by FPL, CONTRACTOR responsible to coordinate, <br />schedule, and accept, off-load, and store. Upon acceptance of materials, <br />CONTRACTOR shall assume responsibility for condition and storage. <br /> <br />6.3 ADJUSTING PROGRESS SCHEDULE <br /> <br />A. The CONTRACTOR shall submit any adjustments in the progress schedule to <br />the ENGINEER for acceptance in accordance with the provisions for "Submittals" <br />in the General Requirements. <br /> <br /> <br /> <br />
