RESOLUTION NO. 2021- <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FOURTH AMENDMENT TO THE AGREEMENT WITH <br />ACTION LABOR MANAGEMENT D/B/A STAFFING CONNECTION FOR SCHOOL <br />CROSSING GUARD SERVICES, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED <br />TWENTY THOUSAND DOLLARS ($220,000.00), ATTACHED HERETO AS EXHIBIT "A"; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE SAID FOURTH AMENDMENT TO <br />THE AGREEMENT AND TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on September 151h, 2016, via Resolution No. 2016-2586 awarded Bid No. 16-04- <br />05 to and entered into an Agreement with Action Labor Management d/b/a Staffing Connection <br />("Action Labor") to provide school crossing guard services ("Services") in an amount not to exceed <br />$229,924.00 for a two (2) year period; and <br />WHEREAS, pursuant to Section 3 of the Agreement the City has the option to renew the <br />Agreement for an additional three (3) one (1) year renewal periods; and <br />WHEREAS, on September 20th, 2018, via Resolution No. 2018-2864 the City Commission <br />approved a First Amendment to the Agreement with Action Labor, thereby exercising its first of <br />three (3) renewal options, in an amount not to exceed $114,962.00; and <br />WHEREAS, on September 19th, 2019, via Resolution No. 2019-2970, the City Commission <br />approved a Second Amendment to the Agreement with Action Labor, thereby exercising its second <br />of three (3) renewal options, in an amount not to exceed $116,936.00; and <br />WHEREAS, on September 17th, 2021, via Resolution No. 2020-3090, the City Commission <br />approved a Third Amendment to the Agreement with Action Labor, thereby exercising its third and <br />final renewal option, in an amount not to exceed $117,876.00; and <br />WHEREAS, the City, being satisfied with the Services performed by Action Labor, wishes to <br />amend Section 3 of the original Agreement to provide that the City has the option to renew for <br />four (4) one (1) year renewal terms, thereby granting the City the ability to renew for one (1) <br />additional year; and <br />WHEREAS, the City further wishes to amend Section 2 of the original Agreement to provide <br />for additional crossing guards at additional locations; and <br />WHEREAS, Action Labor has expressed its ability and desire to continue providing the <br />Services at a revised hourly rate; and <br />WHEREAS, the City wishes approve a Fourth Amendment to the Agreement with Action <br />Labor for school crossing guard services to grant the City the option to renew for an additional one <br />(1) year renewal term, in an amount not to exceed Two Hundred Twenty Thousand Dollars <br />($220,000.00) for the fourth renewal term, bringing the total Agreement amount not to exceed <br />@BCL@300FOO8C.doc Page 1 of 2 <br />
