RESOLUTION NO. 2021- 3?, -
<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
<br />FLORIDA, APPROVING A THIRD AMENDMENT TO THE AGREEMENT WITH
<br />BRIGHTVIEW LANDSCAPE SERVICES, INC. FOR RIGHTS-OF-WAY AND FACILITIES
<br />LANDSCAPE MAINTENANCE SERVICES, IN AN AMOUNT NOT TO EXCEED SIX
<br />HUNDRED FIFTY THOUSAND DOLLARS ($650,000.00); AUTHORIZING THE MAYOR
<br />TO EXECUTE SAID AMENDMENT; AUTHORIZING THE CITY MANAGER TO DO ALL
<br />THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
<br />EFFECTIVE DATE.
<br />WHEREAS, the City of Sunny Isles Beach ("City") issued and advertised Invitation to Bid
<br />("Bid") No. 18-03-03 for Right -of -Ways and Facilities Landscape Maintenance Services
<br />("Services"), and received four (4) responses; and
<br />WHEREAS, on June 21St, 2020, via Resolution No. 2018-2830, the City Commission
<br />awarded the Bid to Luke's Landscaping, Inc. ("Lukes") as the primary awardee, and Superior
<br />Landscape & Lawn Services, Inc. as the secondary awardee; and
<br />WHEREAS, Resolution No. 2018-2830 further authorized the City Manager to negotiate
<br />and enter into an Agreement with Lukes, in an amount not to exceed $1,852,271.10; and
<br />WHEREAS, on October 8th, 2019, the City Manager executed a First Amendment to the
<br />Agreement with Lukes, agreeing to an assignment of interests under the Agreement to
<br />Brightview Landscape Services, Inc. ("Brightview"); and
<br />WHEREAS, on September 171h, 2020, via Resolution No. 2020-3108, the City Commission
<br />ratified the aforementioned First Amendment, and approved a Second Amendment to the
<br />Agreement with Brightview for the Services, thereby exercising its first of three (3) one-year
<br />renewal options, in an amount not to exceed $880,541.19, bringing the total contract amount
<br />not to exceed $2,732,812.29; and
<br />WHEREAS, the City being satisfied with the landscaping maintenance services of
<br />Brightview, and who has expressed its ability and willingness to continue providing these
<br />Services, desires to exercise its second of three (3) one-year renewal options; and
<br />WHEREAS, the City Commission now wishes to approve a Third Amendment to the
<br />Agreement with Brightview Landscape Services, Inc. for Rights -of -Way and Facilities Landscape
<br />Maintenance Services, in an amount not to exceed Six Hundred Fifty Thousand Dollars
<br />($650,000.00), bringing the total contract amount not to exceed Three Million Three Hundred
<br />Eighty -Two Thousand Eight Hundred Twelve Dollars and Twenty -Nine Cents ($3,382,812.29),
<br />attached hereto as Exhibit "A".
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
<br />ISLES BEACH, FLORIDA, AS FOLLOWS:
