ppppppppp—
INC.
ELECTRICAL & UTILITY CONTRACTOR
9/28/2021
Board of City Commissioners
City of Sunny Isles Beach
RE: Hypower, Inc. — Five-year Litigation Disclosure
Commissioners:
888-978-9300 a
24/7 Emergency Service Available
Headquarters
5913 NW 31stAvenue
Fort Lauderdale, Florida 33309
LEED Certified Service and Fleet Yard
1645 NW 33rd Street
Pompano Beach, Flonda 33064
During the past five (5) years, Hypower has been involved in litigation on a limited
number of occasions to (i) protect its right to recover payment or (ii) defend claims by
subcontractors seeking payment beyond that called for by the relevant contract, or in
response to claims (a) asserted by condominium associations against Hypower's
customer a general contractor and most or all the project subcontractors, or (b) to
defend automobile liability or employment law claims. A summary of litigation other
than that covered by insurance defense is attached.
We experience a relatively small amount of litigation considering that Hypower's
annual volume during the same period has included $436 million in total revenue,
involving more than 3000 contract jobs and service work orders. Hypower's
philosophy is to seek early, amicable resolution of disagreements and we actively
negotiate, where possible, to include an escalation of disputes for objective and early
consideration by senior representatives of involved players to avoid the distraction and
expense of litigation. In the event our proposal is competitive, we will be happy to
provide a more detailed information regarding such proceedings.
Respectfully,
Hypower, Inc.
Eric Paul -H s
Senior Vice -President
