RESOLUTION N0.2014- �_2. d( <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF <br />POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME <br />CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION <br />932.7055, F.S., TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE <br />DEPARTMENT OF JUSTICE (DOJ) AND LAW ENFORCEMENT <br />TRUST FUND (LETF) TO PURCHASE A CITYWIDE SECURITY CCTV <br />CAMERA SYSTEM, EMERGENCY TRAFFIC SUPPORT TRAILER AND <br />OTHER PERMISSIBLE ITEMS LISTED ON THE ATTACHED <br />CERTIFICATION, IN AN AMOUNT NOT TO EXCEED ONE MILLION <br />THREE HUNDRED TWENTY -FOUR THOUSAND FOUR HUNDRED <br />FORTY DOLLARS AND EIGHTY -TWO CENTS ($1,324,440.82); <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City <br />and its Police Department are authorized to expend forfeiture funds from the established Department <br />of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to <br />enhance law enforcement purposes; and <br />WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law <br />enforcement agency that acquires at least $15,000.00 pursuant to the Florida Contraband Forfeiture <br />Act with a fiscal year must expend or donate no less than 15% of such proceeds for the support or <br />operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe <br />neighborhood, school resource officer programs or for other law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification that <br />the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request for the purchase of a Citywide <br />Security Closed Circuit Television (CCTV) Camera System, Emergency Traffic Support Trailer, and <br />other permissible items listed on the attached Certification, in an amount of up to One Million Three <br />Hundred Twenty -Four Thousand Four Hundred Forty Dollars and Eighty -Two Cents ($1,324,440.82) <br />in forfeiture (DOJ and LETF) funds in compliance with the aforementioned legal requirements. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, <br />the Chief of Police is hereby authorized to spend up to One Million Three Hundred Twenty -Four <br />Thousand Four Hundred Forty Dollars and Eighty -Two Cents ($1,324,440.82) from the established <br />Department of Justice (DOJ) federal forfeitures account and Law Enforcement Trust Fund (LETF) <br />for the purchase of a Citywide Security Closed Circuit Television (CCTV) Camera System, <br />Emergency Traffic Support Trailer, and other permissible items. <br />R2014- Police Forfeiture (DOJ) Expend Funds Page I oft <br />
