S' ."F '7c <br />T vp <br />B� �F19 0; <br />t1 <br />r} 0A $W A h <br />City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />TO: Honorable Mayor and City Commissioners <br />FROM: Stan Morris, City Manager <br />DATE: January 20, 2022 <br />RE: Resolution to Amend Agreement with Beach Club Acquisitions, LL( <br />Regarding the Turnberry Sales Center <br />RECOMMENDATION: <br />This resolution is recommended for approval. <br />REASONS: <br />In 2014 Beach Club Acquisitions, LLC ("Beach Club") submitted an application to the City requestin, <br />approval to construct a temporary sales center office at the property located at 215 185th Street, <br />Sunny Isles Beach, Florida for the project currently known as Turnberry. Pursuant to the resolutior <br />approving the sales center, Beach Club agreed to remove the sales center once they obtained TCO for <br />the Turnberry project. <br />In 2016 the City acquired the property from Beach Club through a land donation in exchange fol <br />TDR's, and entered into a lease with Beach Club for lease of the subject property. In 2019 the IeasE <br />was amended to provide that Beach Club would pay $5,000 per month in rent. <br />The City and Beach Club now wish to terminate the lease, however, the City administration believes ii <br />would be in the best interest of the City to maintain the building that was utilized as the sales center <br />on the property so that it can be used for a municipal purpose. <br />Following negotiations, Beach Club has agreed to surrender, and the City has agreed to accept, the <br />property with the associated building in "as is" condition, and in consideration, Beach Club will pay the <br />City $155,610.00. <br />Furthermore, Beach Club will pay all past due rent amounts, which total $150,000.00. <br />Item Number: 10.1 <br />105 <br />
