tiNNr•�[Fs <br />SECOND AMENDMENT TO THE AGREEMENT BETWEEN <br />THE CITY OF SUNNY ISLES BEACH AND <br />G. CONCRETE DEVELOPMENT, INC. <br />CONTRACT NO. 2019-7291 <br />This Second Amendment to the Agreement between the CITY OF SUNNY ISLES BEACH <br />("City") and G. CONCRETE DEVELOPMENT, INC. ("Contractor") executed this,?? day of <br />February 2022, is made a part of the original Agreement dated December 24, 2019, attached hereto <br />as Attachment "A", as amended, and incorporated herein by reference, between the City and the <br />Contractor, whose Federal Identification # is 46-0712486. The City and Contractor hereby agree as <br />follows: <br />'V1 <br />1. ADDITIONAL SERVICES. Pursuant to Section 22 of the Agreement, the Parties <br />hereby wish to amend Section 3 of the Agreement ("Services") to include relocation of the <br />existing electrical panel to the north end of the site to allow for flexibility in future development, <br />as described in Contractor's proposal attached hereto as Exhibit "A", which is incorporated <br />herein by reference ("Additional Services"). <br />2. ADDITIONAL COMPENSATION. Payment to Contractor is hereby amended to <br />include additional compensation in the amount of Fifty -Three Thousand Six Hundred Seventy <br />Dollars and Forty -Three Cents ($53,670.43) for the Additional Services, as well as for increases <br />in labor and material costs resulting from permit delays. <br />3. EXTENDING TERM. The term of the Agreement is hereby amended to provide that <br />Substantial Completion of the Project shall occur no later than Two Hundred Seventy -Five (275) <br />calendar days from the date of issuance of all permits, and Final Completion shall occur no later <br />than Three Hundred Five (305) calendar days from date of issuance of all permits, subject to the <br />City's ability to terminate in accordance with Section 10 of the Agreement. <br />4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, <br />all terms and conditions -of the original Agreement any amendments thereto, shall remain in full force <br />and effect. <br />5. CONFLICTING PROVISIONS. The terms, statements, requirements, or provisions <br />contained, in this First Anididment shall prevail and be given superior effect and priority over any <br />conflicting or inconsistent terms, statements, requirements or provisions contained in any other <br />document or attachmdnt, including but not limited to Attachment "A" and `B". <br />IN WITNESS WHEREOF, the parties hereto have executed this document as of the date <br />mentioned above. <br />WITNE <br />Gam-- <br />Si ature <br />Prin ame <br />G.
