<br />City of Sunny Isles Beach |Request for Qualifications No. 21-11-01 12 <br /> <br />applicability of coverage. If Consultant uses a subconsultant, Consultant shall ensure that <br />subconsultant names City as an additionally insured. <br /> <br /> <br />NOTE: THE CITY OF SUNNY ISLES BEACH, CONTRACT NUMBER AND TITLE MUST APPEAR ON <br />EACH CERTIFICATE OF INSURANCE. THE CITY OF SUNNY ISLES BEACH MUST BE SHOWN AS <br />AN ADDITIONAL INSURED WITH RESPECT TO THIS COVERAGE. <br /> <br />2.11 NO CONTINGENT FEES <br /> <br />Florida Statute 287.055(6)(a) requires the following statement, duly signed and notarized, be <br />included in each submittal: <br /> <br />“The respondent warrants that he or she has not employed or retained any company or person, <br />other than a bona fide employee working solely for the respondent to solicit or secure this <br />agreement and that he or she has not paid or agreed to pay any person, company, corporation, <br />individual or firm, other than a bona fide employee working solely for the respondent, any fee, <br />commission or percentage, gift or other consideration contingent upon or resulting from award or <br />making of this agreement.” <br /> <br />By signing and submitting its Proposal the Proposer hereby certifies that it is in compliance with <br />Florida Statute 287.055(6)(a) regarding contingent fees. <br /> <br />2.12 FEDERAL AND STATE REGULATIONS <br /> <br />The successful Consultant shall comply with all federal, state and local rules and regulations, and <br />any other laws that would apply to operating a similar type of business. <br /> <br /> <br />2.13 BASIS OF COMPENSATION <br /> <br />NO SCHEDULE OF FEES SHALL BE SUBMITTED WITH THIS RFQ SUBMITTAL. <br /> <br />If Firm is awarded a Notice to Proceed and/or a Purchase Order, the Consultant agrees to perform <br />the Professional Services for either: <br /> <br />The Hourly Labor Rate as set forth, with a negotiated upper limit. The Consultant shall be entitled <br />to receive reimbursement for expenses at the Consultant’s exact cost, which the allowed costs have <br />been included in Firm’s fee proposal for each project and approved by the City; or, <br />A negotiated lump sum fee based on the rates set forth plus approved Reimbursable Expenses. <br />Approved Reimbursable Expenses shall be paid to the Firm at exact cost, and upon proof of <br />payment by Firm. Anticipated Reimbursable Expenses shall be included with the Firm’s original fee <br />proposal. <br /> <br />Firm agrees to keep, furnish, and support statements with copies of invoices, statements of times <br />expended, and other supporting documentation as the City may require.
