a. The proposed use shall be consistent with the Comprehensive Plan. <br />b. The establishment, maintenance or operation of the proposed use shall not <br />be detrimental to or endanger the public health, safety, or general welfare. <br />c. The proposed use shall be consistent with the community character of the <br />immediate neighborhood of the proposed use. <br />d. Utilities, roadway capacity, drainage, and other necessary public facilities, <br />including police, fire and emergency services, shall exist at the City's adopted <br />levels of service, or will be available concurrent with demand as provided for in <br />the requirements of theses LDRs. <br />e. Adequate measures exist or shall be taken to provide ingress and egress to <br />the proposed use in a manner that minimizes traffic congestion in the public <br />streets. <br />f. The establishment of the conditional use shall not impede the development <br />of surrounding properties for uses permitted in the zoning district; and <br />g. The design of the proposed use shall minimize adverse effects, including <br />visual impacts, of the proposed use on adjacent property through the use of <br />building orientation, setbacks, buffers, landscaping and other design criteria. <br />Comments: The Applicant is seeking a conditional use approval to include a private <br />members club, pursuant to the zoning code section §265-35(C)(3), offering <br />memberships to the residents of La Playa Beach and to the public. The private <br />members club will have access to a private spa totaling 8,000 square feet and a <br />beach bar and grill restaurant totaling 5,200 square feet (indoor and outdoor dining). <br />The private club use, as part of the amenities of the project, is consistent with the <br />community character of its surrounding neighborhood. Please see attached <br />Applicants' letter of intent. <br />4. Traffic Engineering <br />Traffic Impact Study: <br />The Applicant submitted a traffic report date stamped January 14, 2022, prepared by David <br />Plummer & Associates, Inc. The report has been reviewed by the City's Consultant Diana <br />White, PE from Calvin, Giordano & Associates. The City's Consultant has conditionally <br />approved the traffic study and submitted plans with the attached memo dated January 31, <br />2022. The remaining comments, per attached memo, shall be addressed prior to <br />submitting for building permits. <br />Shared Parking: <br />The Applicant submitted a shared parking report date stamped received January 26, 2022, <br />prepared by David Plummer & Associates, Inc.
