Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 9 Contract Number: GS-07F-0031W <br />(3) The Government's acceptance of any rental payment under this clause, in whole or in part, <br />shall not be construed as a waiver or relinquishment of any rights it may have against the <br />Contractor stemming from the Contractor's unauthorized use of Government property or any <br />other failure to perform this contract according to its terms. <br />(g) Use revocation. At any time during the rental period, the Government may revoke nongovernmental <br />use authorization and require the Contractor, at the Contractor's expense, to return the property to the <br />Government, restore the property to its pre -rental condition (less normal wear and tear), or both. <br />(h) Unauthorized use. The unauthorized use of Government property can subject a person to fines, <br />imprisonment, or both, under 18 U.S.C. 641. <br />52.223-2 AFFIRMATIVE PROCUREMENT OF BIOBASED <br />PRODUCTS UNDER SERVICE AND CONSTRUCTION <br />CONTRACTS (SEP 2013) <br />(a) In the perfonnance of this contract, the contractor shall make maximum use of biobased products <br />that are United States Department of Agriculture (USDA) -designated items unless — <br />(1) The product cannot be acquired — <br />(i) Competitively within a time frame providing for compliance with the contract <br />performance schedule; <br />(ii) Meeting contract performance requirements; or <br />(iii) At a reasonable price. <br />(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 <br />CFR 3201.3(e)). For example, all USDA -designated items are exempt from the preferred <br />procurement requirement for the following: <br />(i) Spacecraft system and launch support equipment. <br />(ii) Military equipment, i.e., a product or system designed or procured for combat or <br />combat -related missions. <br />(b) Infonnation about this requirement and these products is available at http://www.bioi�referred.aov. <br />(c) In the perfonnance of this contract, the Contractor shall — <br />(1) Report to the environmental point of contact identified in paragraph (d) of this clause, with a <br />copy to the Contracting Officer, on the product types and dollar value of any USDA -designated <br />biobased products purchased by the Contractor during the previous Government fiscal year, <br />between October 1 and September 30; <br />(2) Submit this report no later than — <br />(i) October 31 of each year during contract perfonnance; and <br />(ii) At the end of contract perfonnance. <br />52.232-40 PROVIDING ACCELERATED PAYMENTS TO SMALL <br />BUSINESS SUBCONTRACTORS (DEC 2013) <br />(a) Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated <br />Page:33 of 211 <br />
