Offer Preparation Instructions and Evaluation Criteria <br />various manufacturers and the differences in performance required to accomplish or produce required <br />end results, production and distribution facilities, price, compliance with delivery requirements, and <br />other pertinent factors. By providing a selection of comparable supplies or services, ordering activities <br />are afforded the opportunity to fulfill their requirements with the item(s) that constitute the best value <br />and that meet their needs at the lowest overall cost. <br />(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the offeror <br />within the time for acceptance specified in the offer, shall result in a binding contract without further <br />action by either party. Before the offer's specified expiration time, the Government may accept an offer <br />(or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of <br />withdrawal is received before award. <br />Begin Regulation <br />552.238-76 Use of Non -Government Employees to Review Offers <br />(May 2019) <br />(a) The Government may employ individual technical consultants/advisors/contractors from the below <br />listed organizations to review limited portions of the technical, management and price proposals to <br />assist the government in both pre -award and post -award functions. [The contracting of should <br />insert a list of organizations used to review solicitation responses and execute a non -disclosure and <br />organizational conflict of interest statement for all individuals conducting reviews.] <br />To be determined at the task order level <br />(b) These representatives will be used to advise on specific technical, management, and price matters <br />and shall not, under any circumstances, be used as voting evaluators. However, the Government may <br />consider the advice provided in its evaluation process. In addition, Contractor personnel may be used in <br />specific contract administration tasks (e.g., administrative filing, review of deliverables, etc.). <br />(c) If individual technical consultants/advisors/contractors are utilized as described in (b) above, they <br />will be required to execute a non -disclosure and organizational conflict of interest statements. <br />Begin Regulation <br />552.238-77 SUBMISSION AND DISTRIBUTION OF AUTHORIZED <br />FEDERAL SUPPLY SCHEDULE PRICE LISTS (MAR 2020) <br />(a) The Contractor shall submit its Authorized Federal Supply Schedule Price List on a common -use <br />electronic medium as prescribed by GSA.
