47QSMD20R0001 Refresh: 0009 Section III Contract Terms and Conditions <br />Section III Contract Terms and Conditions <br />This section outlines solicitation provisions and clauses applicable to Schedule contracts throughout the life of <br />the contract. Please refer back to the instructional provisions within this solicitation, whenever you are making <br />changes or updates to your contract. <br />Contract terms and conditions are split into two sections for organizational purposes only. Their placement here <br />has no effect on their meaning or application. Rather, the terms and conditions are organized this way merely to <br />help you better manage and understand your Schedule contract. All terms and conditions listed in this <br />solicitation are incorporated into your contract at the Schedule level. <br />Incorporated by Reference (IBR): Many of the provisions and clauses cited in this solicitation are incorporated <br />by reference, as authorized in the Federal Acquisition Regulation (FAR) or the General Services Administration <br />Acquisition Manual (GSAM). A review of these clauses and provisions will be necessary for you to understand <br />all aspects of the solicitation. The full text of any FAR and GSAM clauses which are incorporated by reference in <br />this solicitation may be found in the electronic file titled 'Regulations Incorporated by Reference', or they can be <br />accessed at the following URLs: FAR: https://www.acquisition.gov/far/ GSAM: <br />https://www.acquisition.gov/gsam/gsam.html <br />Begin Regulation <br />52. 223-99 ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS <br />FOR FEDERAL CONTRACTORS (OCT 2021) (DEVIATION) <br />(a) Definition. As used in this clause - <br />United States or its outlying areas means <br />(1) The fifty States; <br />(2) The District of Columbia; <br />(3) The commonwealths of Puerto Rico and the Northern Mariana Islands; <br />(4) The territories of American Samoa, Guam, and the United States Virgin <br />Islands; and <br />(5) The minor outlying islands of Baker Island, Howland Island, Jarvis <br />Island, Johnston Atoll, Kingman Reef, Midway Islands, Navassa Island, <br />Palmyra Atoll, and Wake Atoll. <br />(b) Authority. This clause implements Executive Order 14042, Ensuring Adequate <br />COVID Safety Protocols for Federal Contractors, dated September 9, 2021 <br />(published in the Federal Register on September 14, 2021, 86 FR 50985). <br />(c) Compliance. The Contractor shall comply with all guidance, including <br />guidance conveyed through Frequently Asked Questions, as amended during the <br />performance of this contract, for contractor or subcontractor workplace locations <br />published by the Safer Federal Workforce Task Force (Task Force Guidance) at <br />https:/www.saferfederalworkforce.gov/contractors/. <br />(d) Subcontracts. The Contractor shall include the substance of this clause, <br />including this paragraph (d), in subcontracts at any tier that exceed the simplified <br />acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the <br />date of subcontract award, and are for services, including construction, <br />performed in whole or in part within the United States or its outlying areas. <br />(End of clause) <br />Note: Regulation 52.223-99 <br />The Government will take no action to enforce the clause implementing requirements of <br />Executive Order 14042, absent further written notice from the agency, where the place of <br />Page: 30 of 141 <br />
