DocuSign Envelope ID: C327FODO-D8DF-4343-B5DB-90853D1ED8AA <br />Exhibit A - RFP E-03-22 <br />The Contractor and/or his subcontractors making deliveries shall be fully responsible for any errors <br />or mistakes that require clean up or ground sterilization. Contractor will be responsible for prompt <br />and thorough cleanup of all spillage per EPA specifications and for any agencies fines or fees for <br />any contamination that result from improper delivery of fuel. <br />11. PRIORITY DELIVERIES: <br />Preference of deliveries shall be given to agencies providing emergency relief and response <br />services and members of the co-op who are participating in this contract, in case of declared <br />emergencies or natural disasters. <br />Proposers shall attach an emergency plan that assures continued deliveries of these products <br />in case of emergencies and/or when additional quantities may be required. <br />12. WORK SITE SAFETY/SECURITY: <br />The carrier shall at all times guard against damage or loss to the delivery site property, the Carrier's <br />own property, and/or that of other contractors, and shall be held responsible for replacing or <br />repairing any such loss or damage. When applicable, the Carrier shall provide fences, signs, <br />barricades, flashing lights, etc. necessary to protect and ensure the delivery site(s) and insure that <br />all county, State of Florida, OSHA, and other applicable safety regulations are met. Additionally, <br />carrier shall provide for the prompt removal of all debris from delivery sites. All participating <br />agencies may withhold payment or make such deductions as deemed necessary to ensure <br />reimbursement or replacement for loss or damage to property through negligence of the Carrier or <br />its agents. <br />13. ADDITION OF DELIVERY SITES: <br />Each Participating Agency shall be able to add delivery sites to the attached list, with 7 days notice <br />to the seller. <br />Page 9 of 9 <br />
