If Consultant uses a subconsultant, Consultant shall ensure that subconsultant names City as an additionally insured. THE COI MUST REMAIN ACTIVE DURING THE TERM OF THE CONTRACT. 2.9 NO CONTINGENT FEES Florida Statute 287.055(6)(a) requires the following statement, duly signed and notarized, be included in each submittal: "The respondent warrants that he or she has not employed or retained any company or person, other than a bona fide employee working solely for the respondent to solicit or secure this agreement and that he or she has not paid or agreed to pay any person, company, corporation, individual or firm, other than a bona Fide employee working solely for the respondent, any fee, commission or percentage, gift or other consideration contingent upon or resulting from award or making of this agreement. " By signing and submitting its Proposal the Proposer hereby certifies that it is in compliance with Florida Statute 287.055(6)(a) regarding contingent fees. 2.10 FEDERAL AND STATE REGULATIONS The successful Firm shall comply with all federal, state and local rules and regulations, and any other laws that would apply to operating a similar type of business. 2.11 BASIS OF COMPENSATION NO SCHEDULE OF FEES SHALL BE SUBMITTED WITH THIS RFQ SUBMITTAL. If Firm is awarded a Notice to Proceed and/or a Purchase Order, the Consultants agrees to perform the Professional Services for either: The Hourly Labor Rate as set forth, with a negotiated upper limit.
