,rr or SOS <br />responsible for additional costs, if any, of the project to the proportional extent caused by <br />such negligent errors or omissions. <br />2.8.7 General <br />City reserves the right to review and revise any insurance requirements at the time of <br />renewal or amendment of any Contract the parties enter into, including, but not limited to, <br />deductibles, limits, coverage, and endorsements based on insurance market conditions <br />affecting the availability or affordability of coverage, or changes in the scope of work or <br />specifications that affect the applicability of coverage. If Consultant uses a subconsultant, <br />Consultant shall ensure that subconsultant names City as an additionally insured. <br />NOTE: THE CITY OF SUNNY ISLES BEACH, CONTRACT NUMBER AND TITLE MUST <br />APPEAR ON EACH CERTIFICATE OF INSURANCE. THE CITY OF SUNNY ISLES BEACH <br />MUST BE SHOWN AS AN ADDITIONAL INSURED WITH RESPECT TO THIS COVERAGE. <br />THE COI MUST REMAIN ACTIVE DURING THE TERM OF THE CONTRACT. <br />2.9 NO CONTINGENT FEES <br />Florida Statute 287.055(6)(a) requires the following statement, duly signed and notarized, be <br />included in each submittal: <br />"The respondent warrants that he or she has not employed or retained any company or person, <br />other than a bona fide employee working solely for the respondent to solicit or secure this <br />agreement and that he or she has not paid or agreed to pay any person, company, corporation, <br />individual or firm, other than a bona Fide employee working solely for the respondent, any fee, <br />commission or percentage, gift or other consideration contingent upon or resulting from award or <br />making of this agreement. " <br />By signing and submitting its Proposal the Proposer hereby certifies that it is in compliance with <br />Florida Statute 287.055(6)(a) regarding contingent fees. <br />2.10 FEDERAL AND STATE REGULATIONS <br />The successful Firm shall comply with all federal, state and local rules and regulations, and any <br />other laws that would apply to operating a similar type of business. <br />2.11 BASIS OF COMPENSATION <br />NO SCHEDULE OF FEES SHALL BE SUBMITTED WITH THIS RFQ SUBMITTAL. <br />If Firm is awarded a Notice to Proceed and/or a Purchase Order, the Consultants agrees to perform <br />the Professional Services for either: <br />The Hourly Labor Rate as set forth, with a negotiated upper limit. The Consultant shall be entitled <br />to receive reimbursement for expenses at the Consultant's exact cost, which the allowed costs have <br />been included in Firm's fee proposal for each project and approved by the City; or, <br />City of Sunny Isles Beach I Request for Qualifications No. 21-10-01 <br />
