<br />City of Sunny Isles Beach |Request for Proposal No. 22-04-01 20 <br /> <br />Under the policy, City funds may not be expended to purchase Styrofoam food services articles <br />for use or sale in City facilities or on City property. This includes funds used by City employees or <br />used to pay City Contractors or vendors. Styrofoam food service articles will no longer be <br />permitted to be sold or used in City facilities or on City properties by contractors or vendors that <br />are paid with City funds. A violation of this section shall be deemed a default under the terms of <br />the City contract, lease or concession agreement and is grounds for revocation of a special event <br />permit. Click here to access more information on the City’s Ecommitted campaign. <br />2.26 PLASTIC BEVERAGE STAWS PROHIBITED <br />Beginning January 2, 2020 no Beverage Provider or Food Provider within the municipal boundaries <br />of the City shall sell, distribute, or provide Plastic Beverage Straws to customers who have <br />purchased a ready to drink beverage for consumption on or off the premises. This prohibition <br />shall not apply to: (1) Pre-packaged drinks sold at commercial establishments where Plastic <br />Beverage Straws have been attached to or sealed with a Beverage container by the manufacturer. <br />(2) Use by medical or dental facilities. (3) Use by the School District or county, state or federal <br />governmental entities. (4) Use during a locally declared emergency. (5) Use by individuals with a <br />disability or other impairment requiring use of a Plastic Beverage Straw. <br /> <br />2.27 PUBLIC RECORDS LAW <br /> <br />The City is subject to Chapter 119, Florida Statutes, “Public Records Law.” No claim of <br />confidentiality or proprietary information in all or any portion of a response will be honored unless <br />a specific exemption from the Public Law exists and is cited in the response. An incorrectly claimed <br />exemption does not disqualify the firm, only the exemption claimed. Contractor acknowledges <br />the public shall have access at all reasonable times, to all documents and information pertaining <br />to City’s contracts, subject to the provisions of Chapter 119, Florida Statutes, and agrees to allow <br />access by the City and the public to all documents subject to disclosures under applicable law. To <br />the extent that Contractor has been provided access to or has received security sensitive <br />information, as defined by Florida Statutes, Section 119.071 and/or has executed a Confidential <br />Information Acknowledgement and Agreement as part of the ITB process, Contractor shall keep <br />and maintain the security sensitive information as confidential and exempt from public <br />disclosures as required by Florida Statutes. <br /> <br /> <br />IF THE CONTRACTOR HAS QUESTIONS REGARDING THE <br />APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO THE
