RESOLUTION NO. 2022 - S511 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE <br />FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF A <br />MARINE PATROL VESSEL, AND POLICE TRAINING, EQUIPMENT, AND COMMUNITY <br />EVENTS, IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FIFTY-NINE <br />THOUSAND SIX HUNDRED SIXTY-NINE DOLLARS AND NINE CENTS ($359,669.09), <br />ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for the approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements for the purchase of a marine patrol <br />vessel, and police training, equipment, and community events, in an amount not to exceed Three <br />Hundred Fifty -Nine Thousand Six Hundred Sixty -Nine Dollars and Nine Cents ($359,669.09), <br />attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached <br />certification, the Chief of Police is hereby authorized to spend up to Three Hundred Fifty -Nine <br />Thousand Six Hundred Sixty -Nine Dollars and Nine Cents ($359,669.09), attached hereto as Exhibit <br />"A", from the established Department of Justice federal forfeitures account for the purchase of a <br />marine patrol vessel, and police training, equipment, and community events. <br />Section 2. Effective Date.
