transmitted by a written addendum which will be posted and must be acknowledged by <br />Proposer. <br />1.5. ELIGIBILITY: <br />To be eligible to respond to this competitive solicitation, the proposing firm or principals <br />must demonstrate that they, or the principals assigned to the project, have successfully <br />provided services similar magnitude to those specified in the Scope of Services section of <br />this competitive solicitation to at least one City similar in size and complexity to the City <br />of Parkland or can demonstrate they have the experience with large scale private sector <br />clients and the managerial and financial ability to successfully perform the services. The <br />proposing firm shall also demonstrate the following: <br />(a) The Contractor shall have been continuously engaged in the business of providing <br />Vending Machines Operation and Maintenance to local governments and/or projects <br />of similar size for at least five (5) years. <br />(b) The Contractor has no conflict of interest with regard to any other work performed <br />by the firm for the City of Parkland. <br />(c) No solicitation will be accepted from, nor will any contract be awarded to, any <br />person, who is in arrears to the City of Parkland, upon any debt or contract, or who <br />is a defaulter, as surety or otherwise, upon any obligation to said City, or who is <br />deemed irresponsible or unreliable by the City. <br />1.6. ❑ BID BOND (Applicable if box checked): <br />1.6.1. Each Proposal must be accompanied by a certified or cashier's check or by a <br />Bid Bond made payable to the City of Parkland on an approved form, duly <br />executed by the Proposer as principal and having as surety thereon a surety <br />company acceptable to the City and authorized to write such Bid Bond under <br />the laws of the State of Florida, in an amount not less than five percent (5%) <br />of the amount of the Base Bid (including any allowances) exclusive of any bid <br />alternates. The City reserves the right to reject any and all security tendered <br />to the City. <br />1.6.2. The bid bond of the Successful Proposer will be retained until such Proposer <br />has executed the Contract and furnished the required payment and <br />performance bonds, whereupon the bid bond will be returned. If the <br />Successful Proposer fails to execute and deliver the Contract, provide proof of <br />the required insurance coverage(s) and furnish the required payment and <br />performance Bonds (if applicable), within seven (7) business days of the Notice <br />of Award, City may annul the Notice of Award and the entire sum of the bid <br />bond shall be forfeited. Bid bond will be returned to unsuccessful Proposer <br />upon execution of a Contract with the successful Proposer. The attorney in <br />fact or other officer who signs a Bid Bond for a surety company must file with <br />such a Bond a certified copy of his power of attorney authorizing him to do so. <br />1.6.3. The bid bond filed with the Proposal shall be forfeited in its entirety to the City <br />as liquidated damages if the Proposer to whom the Contract is awarded fails <br />to execute the Contract Documents within seven (7) business days of the <br />Contract Award. <br />1.6.4. A copy of the bid bond must be included in the submittal.
