4.4. ❑ BID BOND (Applicable if box checked): <br />4.4.1. A scan or copy of the original Bid Bond must be submitted with your electronic <br />Proposal. However, the original (raised seal/thicker stock) paper must be received <br />by U.S. Mail, air, ground courier services, by messenger service; or in person to <br />the address shown below BEFORE the due date of the RFP outlined above. Failure <br />to provide the original Bid Bond prior to the Bid opening WILL result in your Bid <br />being deemed non-responsive. <br />Bid # - Project Name Outlined Above <br />Purchasing Department <br />6600 University Drive <br />Parkland, FL 33067 <br />4.4.2. Each Proposal must be accompanied by a certified or cashier's check or by a Bid <br />Bond made payable to the City of Parkland on an approved form, duly executed <br />by the Proposer as principal and having as surety thereon a surety company <br />acceptable to the City and authorized to write such Bid Bond under the laws of the <br />State of Florida, in an amount not less than five percent (5%) of the amount of the <br />Base Bid (including any allowances) exclusive of any Proposal alternates. The City <br />reserves the right to reject any and all security tendered to the City. <br />4.4.3. The Proposal bond of the Successful Proposer will be retained until such Proposer <br />has executed the Contract and furnished the required payment and performance <br />bonds, whereupon the Proposal bond will be returned. If the Successful Proposer <br />fails to execute and deliver the Contract, provide proof of the required insurance <br />coverage(s) and furnish the required payment and performance Bonds (if <br />applicable) within seven (7) business days of the Notice of Award, City may annul <br />the Notice of Award and the entire sum of the Proposal bond shall be forfeited. <br />Bid bond will be returned to unsuccessful Proposer upon execution of a Contract <br />with the successful Proposer. The attorney in fact or other officer who signs a Bid <br />Bond for a surety company must file with such a Bond a certified copy of his power <br />of attorney authorizing him to do so. <br />4.4.4. The bid bond filed with the Bid shall be forfeited in its entirety to the City as <br />liquidated damages if the Proposer to whom the Contract is awarded fails to <br />execute the Contract Documents within seven (7) business days of the Contract <br />Award. <br />4.4.5. Once the notice to award has been issued, those firms that are not recommended <br />for award must notify the City, within seven (7) business days of the Notice, if the <br />firm wants the original bid bond returned. If a firm wants the bid bond returned, <br />the firm must pick it up from the City. <br />4.5. ❑ PERFORMANCE AND PAYMENT BONDS/IRREVOCABLE LETTER OF CREDIT (Applicable <br />if box checked): <br />4.5.1.
