RESOLUTION NO. 2022 - s , <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, TERMINATING THE LOCAL AGENCY PROGRAM AGREEMENT WITH <br />THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FPN 441646-1-58- <br />01) PROVIDING FOR GRANT FUNDING FOR THE PROPOSED GOVERNMENT <br />CENTER PEDESTRIAN OVERPASS BRIDGE; AUTHORIZING THE CITY MANAGER <br />TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, on September 17, 2020, via Resolution No. 2020-3099, the City Commission <br />of the City of Sunny Isles Beach ("City") approved a grant agreement with the Florida <br />Department of Transportation ("FDOT") to partially fund the construction of a government <br />center pedestrian overpass bridge ("Pedestrian Bridge") in an amount not to exceed Five <br />Hundred Thousand Dollars ($500,000.00) ("Agreement"); and <br />WHEREAS, to date, the City has not received any of the grant funds; and <br />WHEREAS, pursuant to Paragraph 9 of the Agreement, the parties may terminate the <br />Agreement when its continuation would not produce the beneficial results commensurate with <br />the further expenditure of funds; and <br />WHEREAS, the City Commission has determined that the proposed Pedestrian Bridge <br />would not produce the beneficial results commensurate with the further expenditure of funds; <br />and <br />WHEREAS, the City now wishes to terminate the Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified <br />and confirmed as being true and the same are hereby made part of this Resolution. <br />Section 2. Approving the Termination of the FDOT Local Agency Program Agreement. The <br />City Commission hereby approves the termination of the State of Florida Department of <br />Transportation Local Agency Program Agreement dated April 29, 2021 (FPN 441646-1-58-01). <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate this Resolution. <br />Section 4. Effective Date.
